!)RAFT <br /> • On September 19, 2005, a meeting was held at the CIWMB office in Sacramento. During <br /> the meeting Forward Inc. was represented by Chuck Helget, Mike Caprio, Curt Fujii, <br /> Sangeeta Lewis and Kevin Basso. The CIWMB staff that attended the meeting was <br /> Howard Levenson, Mark de Bie, Geralda Styker, Keith Kennedy. The EHD staff that <br /> attended the meeting was Robert McClellon, and Michael Kith. The meeting started with <br /> Mike Caprio asking that the previous violation be revised to areas of concern because <br /> there was disagreement on the definition of green waste and that it could be an issue if <br /> they wanted to revise the permit. Mr. Caprio stated that he was concerned with the <br /> facilities compliance history. Mark de Bie stated that if the violation were not ongoing <br /> that it would not hamper the permitting process. Mark de Bie also stated that it is the <br /> LEA that is making the citation,the appeal would need to start with them. The <br /> discussion moved to the issue of tonnage. Mike Caprio stated that the facility was not in <br /> violation of the tonnage limit if the soils were taken out of the tonnage. Mike Caprio <br /> stated that they would want to see that the soils be allowed above the tonnage limit and <br /> that he felt that they had the approvals necessary to allow it. Mr. Caprio stated that at this <br /> time they were not going to concede ADC, but save that conversation for later. Ms. <br /> Lewis, a consultant for Forward Inc. stated that she had reviewed the CEQA document <br /> and that it clearly analyzed for disposal tonnage at the facility. She provided several <br /> quotes from the document that stated tons disposed. Robert McClellon, stated that the <br /> CEQA document describes the facility operations, numbers and types of equipment, <br /> hours of operations, estimated closure date and other details about the facility, but no <br /> where in the document does it state that Forward Inc. was going to take certain waste <br /> • streams and not count it toward their daily tonnage. Robert McClellon stated that the <br /> facility site life has been revised to 2017 down from 2020. Robert McClellon asked for an <br /> explanation for this change in estimated closure date. Curt Fujii an engineer for Forward <br /> Inc. explained that the facility had experienced an increase in the amount of projected <br /> growth in waste. Robert McClellon asked how could that be,the amount reported as <br /> disposed of has went down for the facility in the last year or so. The Mark de Bie asked <br /> Keith Kennedy, Michael Kith and Robert McClellon to step outside to discuss the options <br /> for resolution. The discussion resulted in agreement that Forward Inc. could take clean <br /> soil above the tonnage limit if the soil was clean soil and that if the facility operators <br /> would have to make a good faith effort to resolving the issues on the RDSI. If Forward <br /> Inc would agree to that the facility would receive areas of concern for the tonnage until <br /> everything was hammered out. This would allow Forward Inc. to avoid being on the list <br /> of site that violate state minimum standards. Mark de Bie, Keith Kennedy, Michael Kith <br /> and Robert McClellon,re-entered the meeting with Forward Inc. we gave them our <br /> proposal. Robert McClellon stated that the definition of clean soil would need to be <br /> determined and the soil could not be considered Class II waste. Curt Fujii stated that <br /> Forward Inc. does not use Class II waste as cover. The meeting ended with an agreement <br /> that Forward Inc. was going to work with the EHD on the definition of clean soil, and <br /> meet with EHD on September 21, 2005 to try and resolve most of the RDSI issues. The <br /> EHD was going to in return wait to the latest date to conduct the inspection in September <br /> and hold the inspection report in abeyance for 30 days as allowed by regulation to allow <br /> the facility time to make changes. <br /> • <br />
