DRAFT <br /> • On September 21, 2005 Robert McClellon of the EHD met with Forward Inc., Curt Fujii, <br /> Kevin Basso, John Boucher and Virginia of Bryan Stirrat and Associates (Bryan Stirrat <br /> and Associates via conference call). Most of what was agreed on was clearing up the <br /> typo's in the document. The site needs for ADC and beneficial reuse, the cover to waste <br /> ratios and site life issues would be provided later. The facility engineer was claiming that <br /> the site life estimate was off from the beginning. Mr. Fujii indicated that it was a mix up <br /> in calculations from the fly over surveys that they conduct annually. I asked him to <br /> provide that in a letter and he stated that he would. He stated that he would be getting me <br /> a letter for clean soil definition. <br /> On September 22, 2005, The Robert McClellon, received an email from Curt Fujii, of <br /> Forward Inc. The email attachment was a word document for the proposed definition of <br /> clean soil I forwarded the letter to Ross Atkinson of the California Regional Water <br /> Quality Control Board(CRWQCB) and to Keith Kennedy of the CIWMB (see exhibit <br /> zz). <br /> On October 12, 2005 Robert McClellon received an email response from Ross Atkinson <br /> of the CRWQCB. The email indicated that the facility should use the attached list to <br /> determine what is a designated waste. I forward the email to Curt Fujii of Forward Inc. <br /> and explained that for the purposes of counting tons of clean soil that Forward Inc. can <br /> receive above the tonnage limit they should use this list(see exhibit AAA) <br /> • On October 21, 2005 Robert McClellon of the HED met with Forward Inc., Curt Fujii <br /> and Kevin Basso. The meeting was held to discuss the site life issue. Curt Fujii explained <br /> that the site life was off due to the fyl over and he explained that the maps get layer over <br /> the top of the old fill. He state that staff of Bryan Stirrat and Associates made a mistake <br /> and that is where the discrepancy lies. I asked for it in a letter. He stated that he thought <br /> that this meeting would be enough to satisfy the EHD. I explained that we would need it <br /> for the historical record for the site. I explained that he could put in the RDSI if he <br /> wanted. He stated that he would get me a letter. There was some previous disagreement <br /> on the definition of clean soil. I asked if they were willing to accept my definition, which <br /> included the list provided from Ross Atkinson of CRWQCB. Curt Fjuii explained that he <br /> had not talked with Ross yet, but would on Monday. Curt Fujii explained that they would <br /> agree to the limits that the CRQWQCB would enforce. I explained that I though Ross <br /> would agree with me and that the issue should be resolved and that I would be able to <br /> issue the inspection report with an area of concern. <br /> October 24, 2005, Curt Fujii of Forward Inc. called Robert McClellon. He explained that <br /> Ross stated that the only limits he could enforce are the limits in the Waste Discharge <br /> Requirements (WDRs). HE stated that Ross Atkinson would issue a letter on the limits in <br /> question. I tried to explain that the EHD has institutionalized that list and use it for <br /> reference in other programs. In order for the EHD to apply it equally it would have to <br /> apply to Forward Inc. Curt Fujii stated that they disagree and would fight the EHD on <br /> • that issue. I explained that the EHD was going to issue the inspection report of September <br />
