E)R F
• On November 16, 2005, Robert McClellon contacted Curt Fujii of Forward Inc via
telephone. Robert McClellon explained that he had talked with Ross Atkinson of the
CRWQCB and the Ross stated that the levels in Forward Inc.'s WDRs may be lowered
and that Forward Inc. would need to justify all levels they propose above the level found
on the list. Robert McClellon explained that the numbers in the list are the number for
clean soil (counting tons that don't count). The levels found in the WDRs would stand as
clean soil, but if those number are lowered by the RWQCB that the clean soil number
would lower. He asked if they are able to get some of the levels to raise, would the levels
for clean soil raise. Robert McClellon explained that they would not. Curt Fujii stated
they did not agree and that they want to have another meeting to discuss the issue.
On November 23 2005, Robert McClellon contacted Curt Fujii via telephone. Mr. Fujii
wanted to go over what I wanted for the definition of clean soil. I explained the number
on the list except for the numbers in the WDRs. If the numbers in the WDR are lowered,
then the new clean soil number will follow, but in no case will they go up. He stated that
they agreed.
VIOLATIONS:
Public Resources Code, Division 30,Part 4, Chapter 3,Article 1, Section 44004
Public Resources Code, Division 30,Part 4, Chapter 3, Article 1, Section 44014(b)
• Title 27, California Code of Regulation, Chapter 4, Subchapter 3,Article 2, Section 21600
Title 27, California Code of Regulation, Chapter 4, Subchapter 3, Article 2, Section 21600
(b)6(B)
Title 27, California Code of Regulation, Chapter 3, Subchapter 4, Article 6, Section
20919.5
•
