40 CFR, Part 60, Subpart WWW (HSPS) <br /> In order for the Federal New Source Performance Standards (NSPS) to apply to <br /> the FL, the facility 1) must be a municipal solid waste facility (MSWF); 2) must <br /> have received MSWF waste on or after November 8, 1987; 3) must have a <br /> design capacity at or above 2.5 million metric tons and 2.5 million cubic meters; <br /> and 4) must generate more than 50 megagrams per year (Mg/yr) of non- <br /> methane organic compounds (NMOL). FL is an MSWF because of its <br /> acceptance of municipal waste, it has accepted waste after November 1987, and <br /> its design capacity is well above 2.5 million metric tons. When the former <br /> Forward Landfill was merged with the Austin Road Landfill in 2004 to create the <br /> current FL, the combined site became an NSPS landfill because the action was <br /> considered a modification after May 30, 1991 per the NSPS. Subsequent <br /> NMOC emission estimates, using NSPS Tier 2 methods, showed NMOL <br /> emissions in excess of the 50 Mg/yr limit, thus triggering the requirement to <br /> install and operate a gas collection and control system (GCCS) in accordance <br /> with the NSPS requirements as defined in 40 CFR Part 60, Subpart WWW. <br /> FL has installed a GCCS, and full compliance with NSPS was initially achieved on <br /> December 10, 2006 to meet NSPS deadlines. At this time, the GCCS is <br /> compliant with all applicable NSPS requirements for operation, monitoring, <br /> recordkeeping, and reporting. In addition, compliance has also been achieved <br /> with the National Emission Standards for Hazardous Air Pollutants (NESHAPS) <br /> under 40 CFR Part 63, Subpart AAAA, which is a companion regulation to the <br /> NSPS for landfills. FL will expand the GCCS to provide continued landfill gas <br /> control within the proposed expansion areas, as necessary, to comply with the <br /> NSPS and NESHAPS as well as any S)VAPCD requirements. <br /> Title V <br /> Title V (40 Code of Federal Regulations, CFR, Part 70) of the Federal Clean Air <br /> Act under the United States Environmental Protection Agency (U.S. EPA) was <br /> established as an Operating Permit Program for "major" sources of air emissions. <br /> "Major" sources of specific air emissions are subject to the requirements of <br /> 40 CFR, Part 70, and must submit to the U.S. EPA a Title V Permit Application. In <br /> addition, landfills that are subject to the NSPS are also subject to 40 CFR, <br /> Part 70, regardless of air emission level.
