40 CFR, Part 60, Subpart WWW (HSPS)
In order for the Federal New Source Performance Standards (NSPS) to apply to
the FL, the facility 1) must be a municipal solid waste facility (MSWF); 2) must
have received MSWF waste on or after November 8, 1987; 3) must have a
design capacity at or above 2.5 million metric tons and 2.5 million cubic meters;
and 4) must generate more than 50 megagrams per year (Mg/yr) of non-
methane organic compounds (NMOL). FL is an MSWF because of its
acceptance of municipal waste, it has accepted waste after November 1987, and
its design capacity is well above 2.5 million metric tons. When the former
Forward Landfill was merged with the Austin Road Landfill in 2004 to create the
current FL, the combined site became an NSPS landfill because the action was
considered a modification after May 30, 1991 per the NSPS. Subsequent
NMOC emission estimates, using NSPS Tier 2 methods, showed NMOL
emissions in excess of the 50 Mg/yr limit, thus triggering the requirement to
install and operate a gas collection and control system (GCCS) in accordance
with the NSPS requirements as defined in 40 CFR Part 60, Subpart WWW.
FL has installed a GCCS, and full compliance with NSPS was initially achieved on
December 10, 2006 to meet NSPS deadlines. At this time, the GCCS is
compliant with all applicable NSPS requirements for operation, monitoring,
recordkeeping, and reporting. In addition, compliance has also been achieved
with the National Emission Standards for Hazardous Air Pollutants (NESHAPS)
under 40 CFR Part 63, Subpart AAAA, which is a companion regulation to the
NSPS for landfills. FL will expand the GCCS to provide continued landfill gas
control within the proposed expansion areas, as necessary, to comply with the
NSPS and NESHAPS as well as any S)VAPCD requirements.
Title V
Title V (40 Code of Federal Regulations, CFR, Part 70) of the Federal Clean Air
Act under the United States Environmental Protection Agency (U.S. EPA) was
established as an Operating Permit Program for "major" sources of air emissions.
"Major" sources of specific air emissions are subject to the requirements of
40 CFR, Part 70, and must submit to the U.S. EPA a Title V Permit Application. In
addition, landfills that are subject to the NSPS are also subject to 40 CFR,
Part 70, regardless of air emission level. This permitting program is implemented
under S)VAPCD Rule 2520 for FL.
Forward Landfill-Project Description 3-4 BRYAN A.STIRRAT&ASSOCIATES
J:\Allied\Forward\2007.0018 Lateral Expansion\Reports\Prof Descrip\021308 Final Proj Des\Sec 3.doc:2/13/2008)
