According to the SJVAPCD, if a facility is subject to emission guidelines (EG) <br /> under 40 CFR Part 62, Subpart GGG or the NSPS, then it shall be subject to <br /> Title V. FL was originally subject to the EG rule when it was promulgated in <br /> 2000 and, therefore, was subject to the Title V permitting program at that time. <br /> A timely and complete Title V Permit Application was filed in 2001, which <br /> resulted in the issuance of the previously described Title V permit for FL. The <br /> SJVAPCD issued, with US EPA Region 9 concurrence, an initial Title V Permit <br /> No. N-339 on May 31, 2002. A Title V renewal application was submitted in <br /> 2006 and is currently under SJVAPCD review. FL's change in status to an NSPS <br /> site in 2004 did not alter the Title V permitting requirements in any way, and <br /> because FL submitted a timely and complete renewal application, the current <br /> Title V permit remains valid until a renewed permit is issued by SJVAPCD. <br /> 3.1.6 HAZARDOUS WASTE FACILITY POST-CLOSURE PERMIT AND RESOURCE <br /> CONSERVATION AND RECOVERY ACT (RCRA) HAZARDOUS WASTE <br /> FACILITY POST-CLOSURE PERMIT <br /> The closed 8-acre Class I portion of FL is located near the landfill entrance. A <br /> Final Closure Plan was submitted to and approved by the RWQCB and the <br /> Department of Toxic Substance Control (DISC) and the Class I area was closed <br /> in 1989. DTSC issued the Hazardous Waste Facility Postclosure Permit, effective <br /> January 1990. The USEPA issued a RCRA Hazardous Waste Facility Postclosure <br /> Permit in May 1991 (effective June 1991). <br /> 3.1.7 FIRE DEPARTMENT PERMIT <br /> FL operates under a general permit issued by the Manteca-Lathrop Fire <br /> Department for fire and life safety inspection, hazardous materials, motor vehicle <br /> fuel dispensing, flammable/combustible fluids, and welding and cutting. <br /> 3.1.8 OTHER PERMITS/APPROVALS <br /> The relocation of the South Creek will require compliance with State and Federal <br /> regulations and may require approvals from the California Department of Fish <br /> and Game (CDFG), the RWQCB, the U.S. Army Corps of Engineers (USACE) for <br /> compliance with Section 404 of the Clean Water Act, San Joaquin County Flood <br /> Control, and the California Department of Water Resources. <br /> Forward Landfill-Project Description 3-5 BRYAN A.STIRRAT&ASSOCIATES <br /> J:\Allied\Forward\2007.0018 Lateral Expansion\Reports\Prof Descrip\021308 Final Proj Des\Sec 3.doc:2/13/2008) <br />
