The applicant's JTD describes creating a wedge of landfill material <br /> north of WMU-A that would keep a buffer area around the WMU-A <br /> boundaries clear of new refuse and then start to build outward and <br /> upward. This plan must have the approval of CalRecycle (now known <br /> as CalRecycle) and RWQCB. <br /> Current Status: The current Forward Landfill Postclosure Permit for <br /> WMU A allows only post-closure monitoring,inspection,and <br /> maintenance activities on WMU A and, therefore,would not allow <br /> expansion of new landfill areas above WMU A. In addition, according to <br /> the Department of Toxic Substances, "The postclosure permit includes <br /> provisions to restrict future land uses. Any future new use of the site will <br /> also require an amendment of the postclosure permit, pursuit to the <br /> specific conditions stated therein. Deed restrictions are also in place that <br /> limit future use of the property and provide notice of its former <br /> hazardous waste landfill uses" (ref: letter to the Office of Planning and <br /> Research regarding Notice of Exemption from CEQA,June 30, 1993). <br /> Forward submitted a post-closure permit renewal application in January <br /> 2013 that continues the current permit's monitoring,inspection, and <br /> maintenance activities with no plans for expansion above VVMU A. <br /> CALRECYCLE and RWQCB have approved Forward's site <br /> development plan as presented in the JTD.
