EI Dorado Street, Stockton, San Joaquin County <br />CONTACT(S): Terry Loeser, General Manager, The Learner Company <br />INSPECTION DATE: 1 February 2008 <br />INSPECTED BY: Mary Boyd, Regional Water Quality Control Board staff <br />ACCOMPANIED BY: Jerry Loeser, The Learner Company <br />OBSERVATIONS AND COMMENTS: <br />Due to the recent rainstorms, lack of vegetative growth, and heavy mud layer on the top of the <br />landfill cover, the inspection was limited to observations of the side slopes on the west, south, <br />and east sides of the landfill cover: <br />1. The western side slope (facing EI Dorado Street) has sparse vegetation, has eroded, has <br />at least three gullies, and numerous rills. The rills and gullies extend from the shoulder to <br />the toe of the slope (see Photos 1 through 4). One section of this slope has sloughed off <br />from mid -point of the slope to the toe of the slope, as shown in Photo 5. One gully <br />(Photos 1 and 2) has erosion down to the clay layer, a depth of at least 1 -foot. <br />2. The southern slope (facing Duck Creek) is nearly bare of vegetation, as shown in Photos <br />6 and 7. This slope has numerous rills. <br />3. The eastern slope has little to no vegetation with fewer and less dense rills than the <br />southern slope. <br />Based on the ubiquitous nature of the rills, gullies, and absence of vegetation, staff notes that <br />the Discharger has violated the conditions of Waste Discharge Requirements Order No. R5- <br />2007-0084 (WDRs) as follows: <br />1. The Discharge has failed to repair forthwith any breach or other cover problem <br />discovered by periodic monitoring, as required by Section C.4 of the WDRs. <br />2. The Discharger has failed to inspect erosion control measures and has failed to <br />implement and complete repairs prior to 1 October. In addition, the Discharger has <br />failed to complete any necessary construction, maintenance, or repairs of precipitation <br />and drainage control facilities to prevent erosion, flooding, and surface drainage from <br />contacting or percolating through wastes, as required by Section C.5 of the WDRs. <br />3. The Discharger has failed to maintain the vegetative cover, provide fertilization as <br />needed, and replant areas that exhibit sparse or inadequate growth, as required by <br />Section C.6 of the WDRs. <br />4. The Discharger has failed to comply with Section E.1 of the WDRs that requires the <br />Discharger to comply with all applicable provisions of Title 27 that are not specifically <br />Approved: <br />
