completing the conditions of approval. The
applicant has had over a year to complete the
required conditions.
During conversations with the County Planning
Department, it was noted that the applicant has
been slow to meet the conditions of the permit.
The applicant received final building permit
approval on July 31, 1996 from the County
building department. The applicant has yet to
meet use permit conditions imposed by SSJID. The
applicant had not met allconditionsof the
Manteca -Lathrop Fire District as of the date of
annexation. After annexation the project site
was no longer under Manteca -Lathrop Fire District
jurisdiction but the City of Manteca. They have
met the County's Public Works Department
conditions, although they must continue to make
payments on the traffic impact fee.
In an attempt to avoid confusion between the
conditions imposed on the County use permit and
this new use permit, staff has incorporated all
conditions of County use permit #UP -95-8. In
addition, approvals are needed from Public Health
(local), SSJID (local), Solid Waste Facilities
permit, San Joaquin County Solid Waste Task Force
approval and Regional Water Quality Control- Board
approval. While the City does not monitor these
permits (each agency monitors its own permit)
staff feels it is important that the applicant's
project be in compliance with the required
permits and therefore attached condition #3 to
the use permit approval.
Staff Recommendation
& Commission Action: Staff recommends the following course of action:
A. Ratify mitigated negative declaration #96-12.
B. Adopt a de minimis impact finding that the
project will not individually or cumulatively
have an adverse -effect on.wildlife, resources.
C. Make the following findings:
1. The proposed use is consistent with the goals
and policies of the General -Plan and any specific
plan.
2. The proposed use is consistent with the
purpose of the applicable district.
3. The proposed use is listed as a use subject
to a use permit in the applicable zone district-
