completing the conditions of approval. The <br />applicant has had over a year to complete the <br />required conditions. <br />During conversations with the County Planning <br />Department, it was noted that the applicant has <br />been slow to meet the conditions of the permit. <br />The applicant received final building permit <br />approval on July 31, 1996 from the County <br />building department. The applicant has yet to <br />meet use permit conditions imposed by SSJID. The <br />applicant had not met allconditionsof the <br />Manteca -Lathrop Fire District as of the date of <br />annexation. After annexation the project site <br />was no longer under Manteca -Lathrop Fire District <br />jurisdiction but the City of Manteca. They have <br />met the County's Public Works Department <br />conditions, although they must continue to make <br />payments on the traffic impact fee. <br />In an attempt to avoid confusion between the <br />conditions imposed on the County use permit and <br />this new use permit, staff has incorporated all <br />conditions of County use permit #UP -95-8. In <br />addition, approvals are needed from Public Health <br />(local), SSJID (local), Solid Waste Facilities <br />permit, San Joaquin County Solid Waste Task Force <br />approval and Regional Water Quality Control- Board <br />approval. While the City does not monitor these <br />permits (each agency monitors its own permit) <br />staff feels it is important that the applicant's <br />project be in compliance with the required <br />permits and therefore attached condition #3 to <br />the use permit approval. <br />Staff Recommendation <br />& Commission Action: Staff recommends the following course of action: <br />A. Ratify mitigated negative declaration #96-12. <br />B. Adopt a de minimis impact finding that the <br />project will not individually or cumulatively <br />have an adverse -effect on.wildlife, resources. <br />C. Make the following findings: <br />1. The proposed use is consistent with the goals <br />and policies of the General -Plan and any specific <br />plan. <br />2. The proposed use is consistent with the <br />purpose of the applicable district. <br />3. The proposed use is listed as a use subject <br />to a use permit in the applicable zone district- <br />
