5. Community Development Department <br /> The Project requires that an EIR as well as revisions to the Conditional Use Permit <br /> are approved or certified by the County. Documentation regarding these approvals <br /> will be forwarded to the EHD when obtained. <br /> According to the April 1993 Draft EIR, the Lovelace Transfer Station and Lovelace <br /> Road area are designated for "General Agricultural" use on the San Joaquin County <br /> General Plan 2010 Land Use Map. In addition, county General Agricultural land use <br /> areas are typically committed to viable commercial agricultural enterprises that <br /> require large land areas to efficiently produce crops. <br /> However, according to the April 1993 Draft EIR, "public, institutional and/or major <br /> impact uses such as the existing transfer station facility are allowed within land use <br /> areas designated for General Agriculture upon securing a Use Permit. The County <br /> Community Development Department staff has determined that the proposed facility <br /> expansion does not require a General Plan Amendment as it is consistent with the <br /> County General Plan land use policies (Sullivan; personal communication)." <br /> Besides the completion of the CEA document for this project (an EIR) and the <br /> revision of the Conditional Use Permit, the Community Development Department <br /> will require that a Improvement Plan Permit and a Grading Permit and/or Building <br /> Permit, be applied for and approved, in accordance with County regulations. <br /> 6. California Department of Conservation <br /> The County may ultimately implement a recycling drop-off program for recyclables <br /> to the east of the transfer station building in a location designated as the "Recycling <br /> Drop-Off Area" on Drawing RSI-2. This area will generally be used by the Non- <br /> Automated Disposal site users to deposit recyclable materials into designated bins. <br /> In addition, a section within the Non-Automated Disposal Area willbe designated for <br /> drop off of recyclables. <br /> If the County elects to be certified by the California Department of Conservation <br /> (CDC) in the future, a copy of the approved CDC certification will be forwarded to <br /> the EHD. <br /> 7. U.S.Army Corps of Engineers <br /> The Corps permits activities which involve modification or filling of water bodies or <br /> wetlands as defined under Section 404 of the Clean Water Act. The type of permits <br /> include Individual, Nationwide or Regional permits and depend on the size or <br /> capacity of the body of water. <br /> The area to be filled for this project is less than one-acre in size and by Corps <br /> regulations a Nationwide Number 26 Permit will be required.
