Facility personnel within close proximity to three pieces of moving heavy machinery. <br /> It is recommended that the local enforcement agency require the operator to instruct the drivers of the heavy <br /> equipment to blow their horn when removing sorted waste from,and traversing,the public side of the facility and <br /> require personnel on the tipping floor to maintain a safe distance from the heavy machinery according to written <br /> operating practices maintained at the facility. <br /> C. AREAS OF CONCERN: <br /> The inspection identified one area of concern of Public Resources Code,Division 30,Part 4,Chapter 3,Article 1: <br /> 1. Section 44014(b)—Operator Complies with the Terms and Conditions of the Permit. The solid waste <br /> facilities permit shall contain all terms and conditions that the LEA determines to be appropriate for the operation <br /> of the solid waste facility. The operator shall comply with all terms and conditions of the permit. <br /> The Lovelace Transfer Station's solid waste facility permit,dated April 1, 1994,allows the facility to accept a <br /> maximum traffic volume of 478 vehicles per day. <br /> Based on the traffic records provided by the operator,the facility exceeds its maximum of 478 vehicles per day on <br /> a consistent basis. <br /> According to the operator only non-automated disposal vehicles were included in the original solid waste facility <br /> permit issued in 1994. The permit should have contained all vehicles that were analyzed for in the environmental <br /> impact report for the facility. <br /> The operator submitted a revised solid waste facility permit application to the local enforcement agency on <br /> January 27,2005,to update the permit to match traffic volume that was analyzed in the environmental impact <br /> report. <br /> This area of concern will be corrected if the CIWMB concurs on the issuance of the revised solid waste facility <br /> permit for the Lovelace Transfer Station at the August meeting. <br /> Page 3 of 4 Inspector <br />
