Guidance for inspection of waste <br /> tire facilities and closed or closing disposal sites and facilities will be issued in a later guidance <br /> document. In the interim, for closed or closing sites, LEAs should refer to LEA Advisory#3 (June 10, <br /> 1993), Site Investigation Process for Closed, Illegal, and Abandoned Disposal Sites for guidance on <br /> inspecting disposal sites which ceased accepting waste prior to any closure requirements (generally <br /> pre-1980 if there are no local requirements). In addition, LEA Advisory No. 13 (May 17, 1994), <br /> provides specific guidance for inspecting wood waste landfills. <br /> The purpose of the state inspection program is to ensure the adequate protection of public health, <br /> safety and the environment at Solid Waste Facilities (SWF) throughout California by uniform <br /> enforcement of State Minimum Standards (SMS). In addition, field inspections provide the <br /> information to initiate most of the Board's enforcement actions. Board inspections of a SWF <br /> establish a compliance status that may be used to evaluate the effectiveness of enforcement programs <br /> of Local Enforcement Agencies (LEAs) and the Board. <br /> In this document, guidance is presented for evaluating a solid waste disposal facility's compliance <br /> with permitting aspects of Division 30 of the Public Resources Code (PRC) and with Title 14, <br /> California Code of Regulations (14 CCR) requirements. Since levels of experience vary among <br /> inspectors, this document is designed for all levels of expertise. Also, statute and regulation guidance <br /> is designed for the individual standard and thus may be repetitive in some instances. <br /> AB 1220 <br /> With the enactment of the Solid Waste Disposal Regulatory Reform Act (AB 1220) as an urgency <br /> statute on October 1, 1993, the Board is required to remove overlap, duplication and conflict with <br /> other State and local agencies in the regulation of solid waste disposal facilities. Full implementation <br /> of this legislation is underway and LEA Advisory No. 8 Revised (8R), General Guidance for <br /> Implementing AB 1220 in the Regulation of Solid Waste Disposal Sites was issued on June 24, 1994. <br /> Consistent with LEA Advisory No. 8R, inspection guidance presented here suggests coordination <br /> with other agencies where there are shared areas of concern,until more detailed procedures can be <br /> worked out among the various regulatory agencies. Once regulations and procedures are revised, <br /> further guidance will be provided in an LEA Advisory. <br /> State Requirements <br /> The Board is required to conduct at least one inspection every 18 months of each solid waste landfill <br /> and transformation facility and submit a written inspection report to the LEA within 30 days of the <br /> inspection (PRC § 43220). The Board may also conduct inspections and investigations of SWF to <br /> evaluate the LEA and to ensure that SMS are met (PRC §§ 43214(a),43219). When the Board is <br /> acting as the EA, it will inspect sites at the frequencies required of the LEA. <br /> Local Requirements <br /> The LEA is required under PRC § 43209 to develop, implement, and maintain an inspection program. <br /> 14 CCR § 18303, requires the LEA to conduct investigations of allegations and of all SWF where it <br /> has reason to believe that a violation exists. In accordance with PRC § 43218, the LEA is required to <br /> inspect each SWF within its jurisdiction at least one time each month.
