Therefore, this
section is not applicable.
15. State or Local Spill Prevention Rules - §112,7(j)
There is a State of California law that applies to aboveground tanks that contain petroleum: the
California Aboveground Petroleum Storage Act(APSA) in the California Health and Safety Code
Section 25270 (H&SC 25270). The APSA requires that facilities complete a SPCC Plan per the 40
CFR 112 requirements, perform monitoring to detect releases, and pay biennial storage statement
fees to the State of California if the aboveground quantities of oil onsite are in excess of the SPCC
Plan requirements in 40 CFR 112. However, notification of a spill must be made to the Cal OES
Warning Center for discharges greater than 10 bbls of oil onto land or any amount of water, and a
follow up written report must be submitted to the San Joaquin County Environmental Health
Department within 30 days.
16. Qualified Oil-Filled Operational Equipment -
§112.7(k)
Oil-filled operational equipment, with capacities greater than 55 gallons utilized at the Facility, is
identified in Table 1.
For the equipment not located within secondary containment, Owens-Brockway has implemented
alternative requirements to general secondary containment for oil-filled operational equipment per
112.7(k)(2) as described below:
• Visual non-documented inspections of oil-filled operational equipment and associated
components for leaks, corrosion, and other conditions that could lead to spills when operations
are on-Site (Section 10.1)
• Documented monthly inspections for leaks, corrosion, and other conditions that could lead to
spills (Section 10.2)
• Preventative maintenance based on regular scheduled visual inspections, tests, or evidence of
oil spills
• Written commitment of manpower, equipment, and materials required to expeditiously control
and remove any quantity of oil discharged that may be harmful (page 3)
• An Oil Spill Contingency Plan is located in Appendix C
Oil-filled equipment is designed and constructed in accordance with good engineering practices and
accepted industry standards. No container is used for oil storage until the compatibility of the oil and
the container's construction material has been evaluated.
GHD I Spill Prevention,Control,and Countermeasure(SPCC)Plan 1085405 1 Page 23
