Several pools, <br /> approximately 5-20 feet in diameter, contained liquid manure and fly larvae. Pictures <br /> were taken at location F on map 1. Image 103_0337 shows one pool of liquid manure. <br /> Mr. Backus and the complainant drove south beyond the end of the perforated pipeline. <br /> The liquid manure ran downhill into a creek bed, which runs parallel to the perforated <br /> pipe. Liquid manure and fly larvae were present in the creek bed. Pictures were taken at <br /> locations G and H on map 1. Image 103_0346 shows liquid manure in the creek bed at <br /> location G. <br /> Mr. Backus and the complainant drove to the west and observed more liquid manure and <br /> fly larvae in a creek bed. Pictures were taken at location I on map 1. Image 103_0361 <br /> shows liquid manure and fly larvae in the creek bed. <br /> Mr. Backus observed excessive numbers of adult flies on APN: 023-180-03. <br /> On October 17, 2005, Robert McClellon and Garrett Backus, employees of the EHD, and <br /> California Fish and Game Officer Lori Oldfather inspected the properties at APN 023- <br /> 180-03 and APN 023-250-02. Officer Oldfather took pictures of the creek bed containing <br /> liquid manure and collected samples. <br /> Mr. McClellon and Mr. Backus inspected the perforated pipe and noted that the pipe runs <br /> underground at the property boundary between 24299 E. Brandt Rd. and APN 023-180- <br /> 03. The pipe is above ground on APN 023-180-03. Pictures were taken at location J on <br /> map 1. Image 103_0368 shows the perforated pipe emerging from the ground. <br /> Mr. McClellon, Mr. Backus and Officer Oldfather drove to the SKS Farms (aka SKS <br /> Enterprises, Inc.) office, at 23709 E Brandt Rd., to discuss the disposal of manure at APN <br /> 023-180-03, Jaime Maldonado, manager of the SKS site, said that the manure was from <br /> SKS and that Gary Silva, owner of APN 023-180-03 and APN 023-250-02, has a verbal <br /> agreement with SKS to accept the manure for application to his land. <br /> Mr. McClellon, Mr. Backus, Mr. Maldonado and Officer Oldfather drove back to APN <br /> 023-180-03, near the perforated pipe, and Mr. McClellon called Mr. Silva. Mr. Silva <br /> agreed to drive to the property within 30 minutes to discuss the disposal of manure on his <br /> property. <br /> Mr. McClellon and Mr. Backus drove east onto APN 023-250-02, also owned by Mr. <br /> Silva, and noted that solid chicken manure had been spread on several acres of this <br /> property. Image 103_0372 shows the solid <br /> chicken manure. <br /> Mr. McClellon, Mr. Backus, Mr. Maldonado and Officer Oldfather met Mr. Silva near <br /> the perforated pipe to discuss the spreading of manure. Mr. Silva said that he has owned <br /> the property for approximately one year. Mr. Silva said that he was accepting the manure <br /> from SKS and spreading it on his 820 acres to improve the productivity of the land. He <br /> 2 <br />
