NARRATIVE January 20,2005 <br /> SKS Enterprise-Gary Silva <br /> uses the land to graze range animals although no animals were on the land at this time. <br /> Mr. Silva said that he spread grass seed and disced the soil using farm equipment. <br /> Mr. Silva and Mr. Maldonado both said that a pipeline runs from a manure lagoon on <br /> SKS property to Mr. Silva's property. The pipe connects to a perforated pipe that runs <br /> along the surface of Mr. Silva's property. Mr. Silva and Mr. Maldonado both said that <br /> liquid manure from the lagoon is pumped periodically onto Mr. Silva's property and <br /> spread using the perforated pipe. Mr. Maldonado stated that three truck loads of solid <br /> chicken manure and three pumper-truck loads of liquid chicken manure are spread every <br /> day on Mr. Silva's property. <br /> Officer Oldfather explained to Mr. Silva that there were two Fish and Game regulations <br /> being violated at the site. Streambeds were altered without permit, and manure was being <br /> discharged into a stream. Officer Oldfather told Mr. Maldonado and Mr. Silva to <br /> immediately stop spreading manure on APN 023-180-03 and APN 023-250-02. <br /> Mr. McClellon explained to Mr. Maldonado that SKS is in violation of their Manure <br /> Management Plan since their plan does not include spreading manure on APN 023-180- <br /> 03 and APN 023-250-02. Mr. Maldonado said that he would spread the manure on a dry <br /> pad on SKS property. <br /> Mr. McClellon explained to Mr. Silva that spreading of manure on his property is <br /> considered solid waste disposal, and is a violation of the San Joaquin County Ordinance <br /> Code. Mr. McClellon explained that spreading of manure is acceptable only if the <br /> manure is disced into the soil within 24 hours, and a crop is planted that absorbs the <br /> nutrients added to the soil. Mr. McClellon also explained that there is no documentation <br /> that the grasses seeded on this land absorb all of the nutrients added to the soil by the <br /> manure. <br /> On December 2, 2005, a meeting was held with SKS representatives at the EHD offices. <br /> SKS was represented by Rolando Calderon and Lily Balestreri. EHD employees present <br /> were Robert McClellon, Michael Kith and Garrett Backus. (See Robert McClellon's <br /> narrative for more details.) <br /> On December 6, 2005, Mr. Backus received a telephone call from SKS representative, <br /> Ms. Balestreri, who stated that Sam Bronson, a rancher who operates at 22990 Brandt <br /> Rd., wanted to use SKS chicken manure on his land. Mr. Backus obtained Mr. Bronson's <br /> telephone number in order to discuss how the manure would be applied. <br /> On December 8, 2005, Mr. Backus received a telephone call from Mr. Bronson. Mr. <br /> Bronson stated that he wanted to thin spread the SKS chicken manure on his ranch land. <br /> Mr. Backus explained that spreading of chicken manure is only acceptable if the land is <br /> specialized farming land that grows a crop, and the manure is disced into the soil within <br /> 24 hours of application. Mr. Bronson stated that his land is ranch land used for grazing <br /> cattle, and SKS would be responsible for discing the manure into the soil. <br /> 3 <br />
