Failing to maintain records of the date, type, and quantities by piecework or <br /> 3 weight of the materials collected and laundered, in violation of Health and Safety Code section <br /> 4 25144. 6(b)(5); <br /> 5 r. Failing to ensure that waste washwater conveyances and containers are <br /> 6 constructed of materials that are impervious under the conditions of use, and are visually inspected at <br /> 7 least twice a year to ensure not leaking into the underlying soil, in violation of Health and Safety <br /> 8 Code section 25144 .6(c) (2) ; and <br /> 9 s. Failing to have a training program in place that ensures the facility personnel <br /> 10 are able to safely and properly handle and clean the reusable soiled textile materials and emergency <br /> 11 procedures to respond to emergencies with equipment and systems, in violation of Health and Safety <br /> 12 Code section 25144 . 6(c) (4) . <br /> 13 4 . Defendant, with actual or constructive knowledge of this Injunction, only in so far as <br /> 14 they are doing business in the State of California, in the course of Defendant' s INDUSTRIAL <br /> 15 LAUNDRY PROCESSING activities in San Joaquin County, are pursuant to Health and Safety Code <br /> 16 section 25515 . 6 hereby permanently enjoined from . <br /> 17 a. Failing to complete and submit Business Owner/Operator Identification page <br /> 18 to the Certified Unified Program Agency (CUPA), in violation of California Code of Regulations, <br /> 19 title 19 section 2652 (a) ( 1 ) ; <br /> 20 b . Failing to complete and/or submit a hazardous materials inventory for all <br /> 21 reportable materials on site, in violation of Health and Safety Code section 25505 ; <br /> 22 c . Failing to complete and/or submit a site map, in violation of Health and Safety <br /> 23 Code section 25505 (a)(2) ; <br /> 24 d. Failing to include emergency response procedures for a release or threatened <br /> 25 release of hazardous materials in business plan, in violation of California Code of Regulations, title <br /> 26 19 section 2658 ; <br /> 27 e. Failing to electronically submit a hazardous materials business plan annually <br /> 28 to the statewide information management system (California Environmental Reporting System) , in <br /> - 4 - <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
