I violation of Health and Safety Code section 25508 (a)( 1 ) (A) s and <br /> 2 f. Failing to have emergency response plan and procedures , the inventory of <br /> 3 hazardous material and the site map readily available to personnel of the business or the unified <br /> 4 program agency, in violation of Health and Safety Code section 25505 (c) . <br /> 5 5 . Defendant with actual or constructive knowledge of this Injunction, only in so far as <br /> 6 they are doing business in the State of California, in the course of Defendant' s INDUSTRIAL <br /> 7 LAUNDRY PROCESSING activities in San Joaquin County, are pursuant to California Business <br /> 8 and Professions Code section 17204 hereby permanently enjoined from: <br /> 9 a. Violating Health and Safety Code sections 25100 et seq. , described in <br /> 10 paragraph 3 — 3s above; <br /> 11 b . Violating Health and Safety Code sections 25500 et seq. , described in <br /> 12 paragraph 4 — 4f above. <br /> 13 6 . Defendants shall pay to Plaintiff the sum of TEN THOUSAND DOLLARS <br /> 14 ($ 10,000 . 00), as and for civil penalties, pursuant to Health and Safety Code §25192, as described <br /> 15 below. The payment shall be due and payable to the below mentioned agencies, and shall be <br /> 16 , delivered to the San Joaquin County Office of the District Attorney, Environmental Crimes Unit. The <br /> 17 TEN THOUSAND DOLLARS ($ 10,000 . 00) will be allocated as follows , at time of signing . <br /> 18 a. $ 5 , 000 . 00 made payable to the Department of Toxic Substance Control — <br /> 19 Toxic Substance Control Account; <br /> 20 b . $2,500 . 00 made payable to the San Joaquin County Environmental Health <br /> 21 Department — Environmental Health Division Trust; and <br /> 22 c . $2,500. 00 made payable to the San Joaquin County Office of the District <br /> 23 Attorney. <br /> 24 7. Defendants shall pay to Plaintiff the sum of TWO THOUSAND FIVE HUNDRED <br /> 25 DOLLARS ($2, 500 . 00), as and for civil penalties, pursuant to Health and Safety Code §25515 . 5 , as <br /> 26 described below. The payment shall be due and payable to the below mentioned agencies, and shall <br /> 27 be delivered to the San Joaquin County Office of the District Attorney, Environmental Crimes Unit. <br /> 28 The TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500 .00) will be allocated as follows, at <br /> - 5 - <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
