EXHIBIT B <br /> STATEMENT OF OVERRIDING CONSIDERATIONS <br /> State CEQA Guidelines Section 15093 <br /> For <br /> H. M. Holloway Landfill Modification Project <br /> Modification of Conditional Use Permit No. 9, Map 28 <br /> Final Environmental Impact Report <br /> (SCH #2002111102) <br /> Lead Agency: Kern County Planning Department <br /> The California Environmental Quality Act ("CEQA") requires a public agency to balance the <br /> benefits of a proposed project against its significant unavoidable adverse impacts in determining <br /> whether to approve the Project. The H. M. Holloway Landfill results in environmental effects <br /> which, although mitigated to the extent feasible by the implementation of mitigation measures <br /> required for the Project, will remain significant and unavoidable, as discussed in the Final <br /> Environmental Impact Report (Final EIR) and the CEQA Findings of Fact. These impacts, <br /> summarized below, are those for which this Statement of Overriding Considerations is made. <br /> 1. Despite the implementation of all feasible mitigation, the impacts to air quality due to <br /> Project level emissions of ozone precursors (NOx, VOC) and PM10 are considered <br /> significant and unavoidable. <br /> 2. Despite the implementation of all feasible mitigation, near term and long term cumulative <br /> emissions of NOx, VOC and PM,o are considered significant and unavoidable. <br /> 3. Despite the implementation of all feasible mitigation, the long term cumulative impacts to <br /> air quality from CO emissions are considered significant and unavoidable. <br /> 4. Despite implementation of all feasible mitigation, impacts to air quality and global climate <br /> change from cumulative greenhouse gas emissions are considered significant and <br /> unavoidable. The Project has incorporated in its design air emission measures for its <br /> operation procedures, mitigation for greenhouse gas emissions, mitigation measures <br /> restricting types of permitted waste streams, end of the day encapsulation of biosolids, a <br /> landfill gas collection system, a landfill gas flare, and onsite equipment engine controls. <br /> Nevertheless, it is concluded that, in the absence of thresholds and a lack of clear <br /> regulatory guidance, and because of the adverse environmental effects of global <br /> warming, the cumulative greenhouse gas emissions will create a considerable <br /> contribution to global climate change. <br /> 5. Despite implementation of all feasible mitigation, cumulative vector impacts are <br /> considered significant and unavoidable.
