Despite implementation of all feasible mitigation, growth inducing impacts are <br /> considered significant and unavoidable. The Project would increase the availability of <br /> disposal facilities for biosolids, a regulated waste stream in California. Although the <br /> Project does not include any applications for sewer plant expansions, it could remove or <br /> reduce an obstacle to growth because the availability of facilities for disposal of biosolids <br /> could allow expansion of sewer plants which in turn. could provide sewer services for <br /> additional growth as a result of this Project. <br /> Findings <br /> This Board of Supervisors finds and determines, in approving the H.M. Holloway Landfill, that it <br /> has considered the identified means of lessening or avoiding the Project's significant effects and <br /> that to the extent any significant direct or indirect environmental effects, including cumulative <br /> Project impacts, remain significant and unavoidable or not mitigated to below a level of <br /> significance after mitigation, such impacts are at an acceptable level in light of the social, legal, <br /> economic, environmental, technological and other Project benefits discussed below, and such <br /> benefits override, outweigh, and make "acceptable" any such remaining environmental impacts <br /> of the Project (CEQA Guidelines Section 15093(a))- <br /> The following benefits and considerations outweigh such significant and unavoidable adverse <br /> environmental impacts. All of these benefits and considerations are based on the facts set forth <br /> in the CEQA Findings, the Final EIR, and the record of proceedings for the Project. Each of <br /> these benefits and considerations is a separate and independent basis that justifies approval of <br /> the Project, so that if a court were to set aside the determination that any particular benefit or <br /> consideration will occur and will justify Project approval, this Board of, Supervisors determines <br /> that it would stand by its determination that the remaining benefit(s) or considerations is, or are, <br /> sufficient to warrant Project approval <br /> Facts <br /> Each benefit set forth below constitutes an overriding consideration warranting approval of the <br /> Project, independent of the other benefits, and the Board of Supervisors determines that the <br /> adverse environmental impacts of the Project are "acceptable" if any one of these benefits will <br /> be realized. The Project will provide benefits to the County of Kern as follows: <br /> 9. Provide for the Environmentally Safe Disposal of Waste Streams that Currently <br /> Are Not Targeted for Recycling and/or Beneficial Reuse <br /> The proposed Project would serve local industries that produce waste streams such as lime <br /> cake, treated auto shredder wastes and spent sandblast media_ These waste streams are <br /> produced locally and not readily recyclable, or have limited potential to be diverted to beneficial <br /> reuse. These wastes are also not currently recycled or normally disposed of at County operated <br /> Solid Waste Facilities. In the case of fly ash, the Project has only taken in the residual wastes <br /> which have not been able to be diverted in the past to other uses. The facility location is in <br /> proximity to heavy industry which produces these wastes, such as the western Kern County oil <br /> producers and co-generation facilities. The Project would serve the disposal needs of these <br /> industries for waste streams that will continue to be produced close by and avoid the <br /> environmental impacts of longer transport to other disposal or diversion facilities.
