0
Title 27 California Code of Regulations §21190- Post Closure Land Use is below:
All proposed postclosure land uses, other than non-irrigated open space, on sites implementing
closure or on closed sites shall be submitted to the EA, RWQCB, local air district and local land
use agency. The EA shall review and approve proposed postclosure land uses if the project
involves structures within 1,000 feet of the disposal area, structures on top of waste, modification
of the low permeability layer, or irrigation over waste.
According to Regulation, the EHD must be notified before changes in land use
occur. Submit a plan for EHD approval for oroposed changes at your facility
within 60 days. Besides the existing violations, a new violation will be cited for
Post Closure Land Use if plan is not submitted and approved prior to using the
new berm as a pistol range. In the plan, include details of bullet traps to prevent
or deter bullets from lodging in soil. In the meantime, cover and grade surfacing
buried waste with the clean dirt brought onto the site, in accordance with the
Work Plan.
Please contact Jenni Frase, Senior REHS, at (209) 468-9966 if you have
questions regarding this matter.
Robert McClellon, Program Coordinator REHS
