The following is an itemized list of hazardous waste violations that have not been addressed for QUEST INDUSTRIES LLC as of January 11, 2021. Open violations from November 04, 2020 inspection Violation#201 -Transported or transferred hazardous waste to a transporter without valid registration. OBSERVATION: Used paint filters are disposed of in a trash dumpster(20 cubic yard size)at the northeast corner of the facility. The trash dumpster is being hauled offsite by Republic Services on a routine basis without using a uniform hazardous waste manifest. A sample of white paint powder was taken from a filter in the dumpster on 11/4/2020 by the San Joaquin County Environmental Health Department(EHD). The sample was labeled as SAMPLE 1,and was tested for the Total Threshold Limit Concentration(TTLC)of inorganic toxic substances. The sample exceeded the non-RCRA hazardous waste threshold as follows: SAMPLE 1: TTLC:Zinc,73,000 mg/kg A hazardous waste transporter license could not be found for Republic Services on the California Department of Toxic Substances Control registered hazardous waste transporter database. VIOLATION GUIDANCE: Except as otherwise provided, it is unlawful for any person to carry on, or engage in,the transportation of hazardous wastes unless the person holds a valid registration issued by the department, and it is unlawful for any person to transfer custody of a hazardous waste to a transporter who does not hold a valid registration issued by the department.A person who holds a valid registration issued by the department pursuant to this section is a registered hazardous waste transporter for purposes of this chapter.Any registration issued by the department to a transporter of hazardous waste is not transferable from the person to whom it was issued to any other person. Any person who transports hazardous waste in a vehicle shall have a valid registration issued by the department in his or her possession while transporting the hazardous waste.The registration certificate shall be shown upon demand to any representative of the department,officer of the Department of the California Highway Patrol, any local health officer, or any public officer designated by the department. CORRECTIVE ACTION: Immediately cease allowing transportation of hazardous waste by a transporter without valid hazardous waste registration.
