Complaint Investigation Summary Report#:5105
COMPLAINT ID: CO0052583 Site Location: 192 E LATHROP RD
Activity Summary
Activity Date Recorded by
09/09/2020 Called the trailer driver and left him a message to call me back to provide the FLORIDO
Penske contact for the spill. Called and spoke to Chris Lorbeer of ERTS, who was
contacted by Penske to coordinate the spill clean-up. Chris referred me to the
ERTS project manager for this incident, Rachel Shealy to obtain the Penske
contact and billing information. Called and left Rachel a voice message.
Found Penske Truck Leasing billing address on Envision Connect, and found
Penske Truck Leasing environmental contact, Brian Yazemboski, on the California
Environmental Reporting System.
Generated and emailed Notice To Abate to Brian Yazemboski.
09/09/2020 Spent extra time revising the Notice To Abate. FLORIDO
09/09/2020 Generated Prop 65, Emergency Response Record Form, and photo log. FLORIDO
10/06/2020 Received and reviewed the final manifest for the waste generated from the spill FLORIDO
clean-up, received on 10/1/2020 from Adam Touchton, ERTS Project Manager.
Emailed Adam back the following: "I still need to know where the absorbent that
was used to absorb the remaining diesel in the tank, ended up. I was told by the
clean-up contractor that the tow truck company had placed absorbent inside the
diesel tank to absorb the remaining 1-2 gallons of diesel, and then the tow truck
company towed the truck with the tank to a Penske yard. Are you able to find out
where the used absorbent that was in the diesel tank went and how it was
managed? Do you know the contact information for the tow truck company?"
10/07/2020 Received the following email from Adam Touchton: "My records show all FLORIDO
absorbents were disposed with our contractor. But if there were some delivered
with the tank, the tow company or the local Penske facility would have disposed
with their bulk shop waste. I do not have a record of this. These are typically not
manifests as a per job waste. By my knowledge, the waste absorbents were left
on site, they used pads to dry out the tank. I hope this helps. AT"
Replied to Adam with the following: "Thank you for the information. I'll reach out to
the Penske's Environmental Contact I have on file to see if he can determine
which facility the absorbent that was in the tank was taken to."
Emailed Brian Yazemboski, Penske Environmental Contact, letting him know I
haven't received all of the information needed to close out this complaint, and
requested he call me.
Adam replied with the following: "Odds are, they will refer you to me. I do not
believe there were any absorbents in the tank when towed away. AT"
I replied to Adam with the following: "Is there any way you can find out the address
where the truck was towed to? Do you have the phone number to the tow truck
company?"
Received a call from Bryan stating that he will try to find out which Penske facility
the truck was towed to and let me know. Received an email from Bryan who states
the trailer was towed to the Penske facility at 2139 Pony Express Ct in Stockton. I
looked up the facility on the internet and found that the address to the facility is
3663 Petersen Rd, Stockton, CA. Called the facility and spoke to the receptionist
(Tidan?)who stated her manager would be the person to assist me, however her
manager wouldn't be in the office until tomorrow. The receptionist transferred me
to her service department to assists me but no one answered. I notified the
receptionist that I will call back tomorrow.
5105.rpt Page 2 of 3
