<br />Soil Investigations for Data Collection in the Delta <br />Initial Study/Proposed Mitigated Negative Declaration 129 <br />Therefore, the Proposed Project is not expected to have a substantial adverse effect <br />on any riparian habitat or other sensitive natural community identified in local or <br />regional plans, policies or regulations or by CDFW or the USFWS. <br /> <br />c) Have a substantial adverse effect on federally protected wetlands as defined <br />by Section 404 of the Clean Water Act (including, but not limited to, marsh, <br />vernal pool, coastal, etc.) through direct removal, filling, hydrological <br />interruption, or other means? <br /> <br />No impact. The Proposed Project would not have a substantial adverse effect on <br />federally protected wetlands as defined by Section 404 of the Clean Water Act <br />because the Proposed Project would not subject wetlands to filling, removal, <br />hydrological interruption or other means. Previously verified pre-jurisdictional <br />determinations will be utilized during mapping and field visits to ensure that the <br />Proposed Project would avoid any areas that, as determined by a wetland specialist, <br />may require a Wetland Delineation. While there would be no impact to federally <br />protected wetlands, implementation of Mitigation Measures MM BIO-1b and MM <br />BIO-12 would further avoid, minimize and/or reduce the potential for impacts. <br /> <br />d) Interfere substantially with the movement of any native resident or migratory <br />fish or wildlife species or with established native resident or migratory wildlife <br />corridors, or impede the use of native wildlife nursery sites? <br /> <br />Less than Significant with Mitigation Incorporated. The Proposed Project would not <br />be expected to substantially interfere with the movement of any native or resident <br />fish species, because the activities conducted overwater would be isolated in area <br />and duration, and would not block, alter or degrade any of the waterways that these <br />species are using for movement or migrations. Implementation of Mitigation Measure <br />MM HYD-1 would reduce potential impacts to water quality to Less than Significant <br />with Mitigation Incorporated (see Section 3.10, Hydrology and Water Quality). <br />Additionally, implementation of Mitigation Measure MM BIO-14 would limit overwater <br />work to only within the appropriate fish work window (August 1-October 31) when <br />sensitive life stages of migratory fish would be less likely to occur in the Study Area. <br /> <br />The Proposed Project would not be expected to substantially interfere with <br />established native resident or migratory corridors or interfere with the use of wildlife <br />nursery sites, because of the limited duration and scope of each Impact Area. <br />Additionally, the implementation of Mitigation Measures MM AES-2 and MM BIO-1 <br />would ensure that migrating animals do not become entrapped or harmed and that <br />no work be conducted outside of daylight hours and no artificial light sources, which <br />could disturb nocturnal wildlife, would be used.
