Complaint Investigation Summary Report #. 5105 <br />COMPLAINT ID: COGBANCPA Site Location: 720 B. ST. <br />Activity Summary <br />Activity Date Recorded by <br />09/01/2020 Received response email from Elena Manzo 'Lead Senior RENS'. Based on email GAITAN <br />I left to go to the BNSF site. <br />Received email from James Farner, HazMat Field Manager for BNSF. Attached <br />was the Safety Data Sheet (SDS) for the lime powder (quick lime). I reviewed the <br />SDS and saw that the lime powder has a pH of 12.44. Forward copy of SDS to <br />Elena. <br />Contacted Elena and discussed complaint. Based on discussion went out to BNSF <br />railroad. Contacted James and notified him that I will be going to BNSF site. He <br />requested I contact him back to provide an update. <br />Met with John Brainard, Supervisor and Shannon Swagerty, Manager. John stated <br />that he went down the main track and observed no lime powder on the main track. <br />John stated that the lime powder is used as a pH neutralizer for agricultural work. <br />He stated that Patriot Environmental and his co-worker Russ are on the main track <br />located in 720 S. B. St. He stated that I would not have access to go on the track. <br />I asked John if any waterways were impacted, he confirmed with me that no <br />waterways were impacted. Contacted Elena and updated her on the complaint, <br />based on conversation I generated a notice to abate. <br />Contacted James, stated that I would be issuing a notice to abate. I asked if BNSF <br />is the responsible party, he stated for now that BNSF is. He stated that I could <br />send the notice to abate to him. He asked why a notice to abate was being issued <br />if the SDS stated the lime powder was non-hazardous. I mentioned that due to the <br />pH being close to 12.5, which would make the lime powder hazardous, a <br />hazardous waste determination on the collected lime powder would have to be <br />made. Discussed that he can test the pH of the lime powder once collected and <br />send me the results. He stated that he would. <br />Contacted Elena and updated her on complaint. Generated notice to abate and <br />sent a copy to Elena for review. <br />09/24/2020 Generated site map. Contacted James Farner, HazMat Field Manager. Gave me <br />the contact to Eddie Philips, maintenance manager, BNSF. James stated the best <br />method to reach Edward was via email. James stated that two bins were sent to <br />the site to recover lime powder and were to be disposed of as hazardous waste. <br />James could not specify how big the bins were or how much lime powder was <br />recovered. Sent email to Eddie Phillips, requested disposal receipts for lime <br />powder. <br />GAITAN <br />09/25/2020 Received email from Eddie Phillips, Maintenance Manager for BNSF. Email stated GAITAN <br />that he would get me a copy of disposal receipts for lime powder once it is <br />removed. He stated that majority of lime powder was released at the B St. <br />location. Stated that patriot environmental recovered lime powder on tracks <br />leading to 6540 s. Austin Rd. location. <br />Attached photos of clean up. Sent response email requesting for total amount of <br />lime powder collected and photos prior to clean up. <br />09/25/2020 Generated prop 65. <br />Gave to Haza Saeed 'Lead Senior REHSI for review. <br />Submitted to Kim Blackwell 'Lead Office' to mail. <br />09/28/2020 Sent email to Edward Phillips, maintenance manager for BNSF.
