We have consulted
legal counsel and discussed your request with staff who are familiar with the
reasons that we recorded the encumbrance on your property.
We found that the encumbrance was placed in order to guarantee cleanup of the
groundwater problem caused by Victor and closure of the waste management units
at the Victor site. Title 23, Division 3, Chapter 15 Section 2580(f) of the
California Code of Regulations requires that a waste discharger establish an
irrevocable closure fund or provide other means to ensure closure and post-
closure maintenance. In lieu of the existing lien, should Victor desire to
provide an alternate financial assurance, we would remove the encumbrance on
the vineyard property so that it could be sold.
Various financial mechanisms have been used to meet financial assurance
requirements at other sites. If you desire to provide an alternate financial
assurance, we will review your proposal .
If you have any questions, please call me at (916) 361-5737.
Qwyw
ROBERT A.
