We have consulted <br /> legal counsel and discussed your request with staff who are familiar with the <br /> reasons that we recorded the encumbrance on your property. <br /> We found that the encumbrance was placed in order to guarantee cleanup of the <br /> groundwater problem caused by Victor and closure of the waste management units <br /> at the Victor site. Title 23, Division 3, Chapter 15 Section 2580(f) of the <br /> California Code of Regulations requires that a waste discharger establish an <br /> irrevocable closure fund or provide other means to ensure closure and post- <br /> closure maintenance. In lieu of the existing lien, should Victor desire to <br /> provide an alternate financial assurance, we would remove the encumbrance on <br /> the vineyard property so that it could be sold. <br /> Various financial mechanisms have been used to meet financial assurance <br /> requirements at other sites.
