Project applicant shall develop and submit an Operations and Maintenance Plan that <br />identifies the operations, maintenance, and inspection requirements of all storm water <br />treatment and baseline hydro modification control measures identified in the approved <br />Project Storm Water Plan. MHCSD approval of the preliminary Operations and <br />Maintenance Plan is precedent to issuance of any building, grading, or construction <br />permits. MHCSD approval of the final Operations and maintenance Plan and recordation <br />of the Maintenance Access Agreement is precedent to issuance of the Certificate of <br />Occupancy. <br />Runoff shall be pretreated on-site prior to discharge into the MHCSD public stormwater <br />collection system. <br />Maintenance condition shall be determined through a self-certification program where <br />MHCSD require annual reports from authorized parties demonstrating proper maintenance <br />and operations. The developer shall sign an agreement with MHCSD for Storm Water <br />Treatment System Access and Maintenance. This agreement shall be transferred to the <br />future owners. <br />F The Phase II Permit (Provision E.12.f) requires that the post-construction storm water <br />runoff flow rate not exceed the estimated pre-project flow rate for the 2-year, 24-hour <br />design storm event. <br />15. Utilities: <br />The Developer and its contractors shall comply with Ordinance No. 4162 "Street Opening <br />and Pavement Restoration Regulations". <br />Any phased development shall install all utilities required to serve the development. In <br />addition, if any future adjacent or nearby phases of the development, or adjacent <br />Neighborhoods, will depend on obtaining service from such utilities, then the utility lines <br />shall be sized to serve these future developments. <br />When public utilities are to be located outside public rights-of-way but within the project <br />boundary, the Developer shall provide public utility easements for these utilities. The <br />easements shall be shown on all the Improvement Plans. <br />Prior to the submittal of improvement plans for the development, the Developer shall submit <br />to the MHCSD composite schematic plans for in tract storm drains, sanitary sewers, and <br />water distribution facilities. <br />Water service to the common areas, if applicable, shall not begin without notifying MHCSD <br />of the intent to start irrigation. The billing process must be setup before water is turned on. <br />Backflow prevention system and applicable water meter facilities at the point of connection <br />to the public water system as required by the MHCSD Standards shall also be installed. <br />All water rights shall be dedicated to the MHCSD upon approval of the Improvement Plans. <br />Transformers located in the commercial and industrial areas may be placed above ground <br />provided they are aesthetically designed and/or shielded by landscaping subject to <br />MHCSD and MID requirements and with prior written approval. <br />Applicant shall submit proof of PG&E clearance via written correspondence to the MHCSD <br />in order to construct proposed improvements within PG&E easement area, if applicable. <br />31
