MHCSD Impact Fees (CFF and TIF): Prior to issuance of each building permit, the Developer <br />shall comply with the applicable requirements of the most current MHCSD adopted CFF and <br />TIF Ordinances in effect at the time the building permit is issued. <br />Vehicles Fees: Prior to the issuance of building permits Developers will deposit in a MHCSD <br />Maintained Vehicle Capital Fund an amount equal to their prorata share (based on the CFF <br />Plan Fee formula as determined by the MHCSD) of the total cost of O&M Vehicles, Police and <br />Fire Vehicles, and Transit Vehicles as contained in the most recent adopted version of the CFF <br />Ordinance. Developer is eligible for fee credits against these funding requirements for any <br />applicable outstanding costs funded as part of prior infrastructure requirements, or applicable <br />fee credits assigned to Developer by other developers within the Community. <br />Hold Harmless Provision: The Developer shall defend, indemnify, and hold harmless the <br />MHCSD, its agents, officers, and employees, from any claim, action, or proceeding against the <br />MHCSD, its agents, officers, or employees, to attack, set aside, void, or annul an approval of <br />MHCSD concerning any MHCSD condition, which action is brought within the time provided for <br />in Section 66499.37 of the Government Code. <br />Funding of MHCSD Development-related Services: All development-related services <br />performed by the MHCSD not already funded by other applicable MHCSD funding mechanisms <br />including special taxes on any development project will be paid by the Developer at the full cost <br />including overhead as determined by the MHCSD General Manager, subject to compliance <br />with all applicable nexus laws and existing agreements between the MHCSD and Developer. <br />All Costs incurred by the MHCSD for any applicant development project shall be paid by the <br />applicant in accordance with the MHCSD Development Project Fees for Services Agreement, <br />dated November 5, 2019, between MHCSD and Rankins AG, Inc, Pinnacle Ridge LLC. <br />5. SAN JOAQUIN COUNCIL OF GOVERNMENTS (Contact: [209] 235-0600) <br />a. This project is subject to the San Joaquin Multi-Species Habitat Conservation and Open Space <br />Plan (SJMSCP). As such, the developer shall complete the following steps to satisfy SJMSCP <br />requirements: <br />Schedule a SJMSCP Biologist to perform a pre-construction survey prior to any ground <br />disturbance. <br />Sign and return to SJMSCP staff of SJCOG the Incidental Take Minimization Measures (given <br />to the developer by SJMSCP staff after the pre-construction has been completed). <br />Pay to SJCOG the SJMSCP fee based on SJMSCP findings. <br />NOTES AND INFORMATION ONLY: <br />See memo from San Joaquin Valley Air Pollution Control District dated July 9, 2020. <br />33
