Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: C00051676 Site Location: 5100 HVVY 12 <br />Activity Date <br />Activity Summary <br />Recorded by <br />02/27/2020 On site at Frank C. Alegre Trucking for cleanup verification with Lead Senior MURO <br />Elena Manzo (EHD). Met with Henry Rotor (Frank C. Alegre Trucking) and <br />Alessandro Alegre (Frank C. Alegre Trucking) in the facility's conference room. <br />We explained that though these chemicals are used for dust control on the <br />ground, they cannot be used for any other use according to San Joaquin Valley Air <br />Pollution Control. Analytical testing was also discussed for the waste. Henry Rotor <br />and Alessandro Alegre decided the waste would be deemed hazardous waste. <br />They will not be having the waste analyzed. They also stated that they will not use <br />the chemicals until they look into their use further. <br />Afterward, Henry Rotor, Elena Manzo, and I walked to inspect the gutter and storm <br />drain cleanup. The gutter and storm drain lid was cleaned up using absorbent <br />pads and absorbent. Henry Rotor lifted the storm drain lid. It was dry inside, no <br />staining was observed at the bottom of the storm drain or the piping. Cleanup of <br />the gutter and storm drain was adequate. <br />All waste generated from the cleanup was placed into a 55-gallon drum and <br />labeled with the following: <br />2-25-2020 START DATE <br />CONTENTS: CONTAMINATED FLOOR SWEEP. LODI CA. 95242. <br />209-810-5209 <br />CAL EPA ID# 000230383 <br />WASTE 352 <br />NON RCRA HAZARDOUSE WASTE (SOLID) <br />Per the discussion we had in the facility <br />s conference room prior to the cleanup verification, Henry Rotor told us he will be <br />changing the label on the 55-gallon drum containing the waste generated from <br />cleanup, and will send me an updated photo of the label. <br />Later the same afternoon, I received an email from Henry Rotor with a photo of the <br />55-gallon drum containing the waste generated from the cleanup. The drum had a <br />yellow hazardous waste label with al required information. <br />02/27/2020 Completed Emergency Response Record and Notification of hazardous Waste MURO <br />Discharge Prop 65. <br />02/27/2020 Received email from James Sanders at: james.sanders@valleyairorg. MURO <br />He reported that the chemical used by Alegre is on the list of chemicals permitted <br />to be used, however, per Rule 8011, any chemical or organic material used for <br />stabilizing solids shall not violate State Water Quality Control Board standards for <br />use as a soil stabilizer. <br />03/04/2020 Reviewed and revised narrative for accuracy. FLORIDO <br />03/06/2020 Sent an email to Meeks, Steven (steven.meeks@waterboards.ca.gov ) describing <br />the complaint details, included SDS's for spilled material, and inquired if his <br />agency would like this case referred to their attention. <br />MANZO <br />03/23/2020 Completed photo log of sample taken on 2-26-20.
