Airport Way, Stockton, CA. <br /> County assessment records indicate that you are the owner of the above referenced <br /> address, As a result of elevated blood lead levels found in a child who resides at this <br /> address, an environmental investigation to identify sources of exposure to lead was <br /> conducted by the San Joaquin County Environmental Health Department (EHD) on <br /> March 30, 2009. Deteriorated paint, dust wipes and bare soil samples were subsequently <br /> tested. Title 17 (T17), California Code of Regulations, Division 1, Chapter 8, Section <br /> 35037 defines a "lead hazard" as deteriorated lead-based paint, lead contaminated dust, <br /> lead contaminated soil, disturbing lead-based paint or presumed lead-based paint without <br /> containment, or any other nuisance which may result in persistent and quantifiable lead <br /> exposure. This property has surfaces, interior and exterior, which are covered with <br /> deteriorating lead-based paint which exceeds the regulatory lead level of one milligram <br /> per square centimeter as defined in T17, Section 35033 and is considered to be a lead <br /> hazard In addition, hazardous soil exceeding T17 definition of"lead-contaminated soil" <br /> which means bare soil that contains an amount of lead equal to, or in excess of, four <br /> hundred parts per million (400 ppm) in children's play areas was found. The results of the <br /> tests are enclosed along with a floor plan and site map showing the locations of test <br /> points. Please note that this investigation does not provide a complete description of the <br /> entire property, and therefore may not identify all lead hazards. <br /> California Health and Safety Codes Sections 105280(a) and (g) provide authority to the <br /> Registered Environmental Health Specialist (REHS) to take enforcement steps to reduce <br /> or eliminate identified exposures. You are therefore instructed to begin action to reduce <br /> these identified sources of exposure within a period of 30 days from the receipt of this <br /> letter. All required lead hazard mitigation shall be completed within 90 days from the <br /> receipt of this letter. Failure to comply with this timeline will result in further legal <br /> enforcement action. <br /> The California Civil Code contains tenant protection remedies to ensure tenants have <br /> access to habitable rental property (i.e. free from lead hazards). These remedies are <br /> specified in the California Civil Code, Sections 1941 and 1942. Civil and criminal <br />
