n 0 <br /> 2 <br /> sanctions for unlawful eviction and other retaliatory measures (e.g. raising the rent) <br /> against tenants as a result of an ordered abatement are also specified in this section. <br /> Sections 17274 and 24436.5 of the California Revenue and Taxation Code provide for the <br /> disallowance of interest, taxes, depreciation, and amortization for substandard property. <br /> Substandard property is rental housing that has been determined to be in violation of the <br /> state and local health, safety, and building codes located in California. A person who <br /> owns such housing may not deduct the above expenses in computing taxable income for <br /> the period the property is in noncompliance. <br /> T17 Section 36100(b) allows property owners to perform interim repairs which are <br /> designed to reduce lead-based paint or lead hazards for less than twenty years. Work shall <br /> be conducted according to procedures specified in Chapter 11: Interim Controls, <br /> "Guidelines for the Evaluation and Control of Lead-Based Paint Hazards in Housing," <br /> U.S. Department of Housing and Urban Development (HUD) June 1995. Work shall be <br /> done using containment and in a manner which does not result in contamination of non- <br /> work areas with lead-contaminated dust, lead-contaminated soil, or lead-based paint <br /> debris. Work not performed according to safe work practices shall result in the issuance <br /> of a stop-work order and may result in further legal action. <br /> Paint film stabilization (stabilizing all deteriorated lead-based paint surfaces by removing <br /> deteriorating paint and repainting) is considered an interim control and may be performed <br /> under the following conditions: <br /> 1. Plastic sheeting, 6 mil, shall be used to capture falling paint chips and make the <br /> cleanup process more efficient. <br /> 2. All loose surface material should be removed by hand treatments (i.e., wet scraping, <br /> wet sanding). <br /> 3. Surface contaminants that prevent adhesion should be,eliminated by cleaning (e.g., <br /> chemical degreasing, trisodium phosphate washing, or other equivalent detergent <br /> followed by thorough rinsing). <br /> 4. Surface gloss should be eliminated by chemical etching or HEPA vacuum-assisted <br /> sanding. Surfaces should be dry before priming or repainting. <br /> 5. Select primer and topcoat by considering longevity, moisture resistance, and organic <br /> compound content with low volatility. Paint film stabilization involves the application <br /> of at least two coats (the primer and the topcoat). Use a primer/topcoat system from <br /> the same manufacturer to ensure compatibility. <br /> Certain paint removal practices are prohibited, including open-flame burning or torching, <br /> machine sanding or grinding without using a HEPA vacuum local exhaust system, <br /> uncontained hydroblasting or sandblasting without using a HEPA vacuum, and use of <br /> heat guns above 1,100 degrees F. Other paint removal practices are not recommended, <br /> including dry scraping (except for limited areas) and use of chemical strippers containing <br /> methylene chloride. <br /> To reduce the soil contamination, after exterior paint stabilization is completed, remove <br /> all visible paint chips from bare soil around the house.
