r <br /> APPENDIX A <br /> EXPLANATION OF REQUIREMENTS <br /> FOOTHILL SANITARY LAND FILL, INC. <br /> San Joaquin County <br /> 1. The discharge shall not cause a pollution of ground or surface waters. <br /> Pollution means an alteration of the quality of the waters of the <br /> state by waste to a degree which unreasonably affects: (1) such waters <br /> for beneficial uses, or (2) facilities which serve such beneficial uses. <br /> Pollution includes contamination which means an impairment of the waters <br /> of the state by waste to a degree which creates a hazard to the public <br /> health through poisoning or through the spread of disease. <br /> 2. Neither the treatment nor the discharge shall cause a nuisance. <br /> Nuisance means anything which: (1) is injurious to health, or is <br /> indecent or offensive to the senses, or an obstruction to the free use <br /> of property, so as to interfere with the comfortable enjoyment of life <br /> or property, and (2) affects at the same time an entire community or <br /> neighborhood, or any considerable number of persons, although the ex- <br /> tent of the annoyance or damage inflicted upon individuals may be <br /> unequal, and (3) occurs during or as a result of the treatment or dis- <br /> charge of wastes. <br /> 3. The discharge shall be limited to Class II solid wastes. <br /> Explained in the attached copy of Resolution No. 69-216, <br /> 4. The site shall be protected from any erosion which may be caused by a <br /> 100 year frequency flood. <br /> (a) Flooding of the site could cause erosion and/or floatation <br /> of deposited wastes out of the site and out of control of the operating <br /> agency, (b) Flooding could cause saturation of the deposited wastes and <br /> lead to the generation of excessive amounts of gaseous and liquid pro- <br /> ducts of decomposition and possible attendant problems of nuisance and/ <br /> or pollution of surface or ground waters. <br /> 5. Any surface runoff from the drainage area tributary to this site shall <br /> be excluded from the disposal site. <br /> Problems similar to (4b) above could be caused by surface drain- <br /> age from surrounding areas. <br /> 6. The top of the site shall be graded to promote lateral runoff of precip- <br /> itation and prevent ponding. <br /> Problems similar to (4b) above could be caused by waters that are <br /> allowed to pond on top of the site. <br />
