Response: The subdivision lies within the airport area of influence boundary, and is bisected by the outer edge of the conical imaginary surface of the runway. Based on the location of the airport relative to the subdivision, public notice to prospective lot purchasers was considered to be appropriate. 2 . Condition No. l. d. Pursuant to Section 66474. 9 of the Subdivision Map Act, the subdivider shall defend, indem- nify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or pro- ceeding against the local agency or its agents, officers, or employees to attach, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision, which action is brought within the time provided for in Section 66499. 37 of the Subdivision Map Act. Basis of Appeal: The County employees, agencies and offi- cers should be responsible for their own actions because certainly the developer and contractors are responsible for their own actions. If the County commits acts of com- mission or omission they should be equally responsible for those acts. Response: Refer to attached letter from County Counsel' s Office which addresses the indemnification provisions con- tained in the State Subdivision Map Act. 3 . Condition No. 2. b. A master circulation plan shall be prepared for the area approved by GP-86-1/ZR-87-34. The interior street layout shall be incorporated into the master circulation plan and constructed to County stan- dards for 50-foot right-of-way farm or estate roads, and conform to one of the two alternate layouts specified by the Department of Public Works and agreed to by the developer. Basis of Appeal: The subdivider should only be respon- sible for a circulation plan within the subdivision, not for a master circulation plan for the whole area.
