Based on the <br /> location of the airport relative to the subdivision, <br /> public notice to prospective lot purchasers was considered <br /> to be appropriate. <br /> 2 . Condition No. l. d. Pursuant to Section 66474. 9 of the <br /> Subdivision Map Act, the subdivider shall defend, indem- <br /> nify, and hold harmless the local agency or its agents, <br /> officers, and employees from any claim, action, or pro- <br /> ceeding against the local agency or its agents, officers, <br /> or employees to attach, set aside, void, or annul an <br /> approval of the local agency, advisory agency, appeal <br /> board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section <br /> 66499. 37 of the Subdivision Map Act. <br /> Basis of Appeal: The County employees, agencies and offi- <br /> cers should be responsible for their own actions because <br /> certainly the developer and contractors are responsible <br /> for their own actions. If the County commits acts of com- <br /> mission or omission they should be equally responsible for <br /> those acts. <br /> Response: Refer to attached letter from County Counsel' s <br /> Office which addresses the indemnification provisions con- <br /> tained in the State Subdivision Map Act. <br /> 3 . Condition No. 2. b. A master circulation plan shall be <br /> prepared for the area approved by GP-86-1/ZR-87-34. The <br /> interior street layout shall be incorporated into the <br /> master circulation plan and constructed to County stan- <br /> dards for 50-foot right-of-way farm or estate roads, and <br /> conform to one of the two alternate layouts specified by <br /> the Department of Public Works and agreed to by the <br /> developer. <br /> Basis of Appeal: The subdivider should only be respon- <br /> sible for a circulation plan within the subdivision, not <br /> for a master circulation plan for the whole area. <br /> Response: The Department of Public Works responds as <br /> follows: <br /> "In light of the County' s proposed General Plan <br /> Amendment and Zoning Reclassification for approxima- <br /> tely 384 acres to rural residential developments , it <br /> will be good planning to prepare a Master Circulation <br /> BOS LETTER PAGE 2 <br />
