1 WHEREAS, Sections 18283 and 18290 of -the Regulations, specify <br /> 2 a pledge of revenue as an acceptable mechanism to demonstrate <br /> 3 financial responsibility for postclosure maintenance costs of a <br /> 4 solid waste landfill; and <br /> shed by Resolution 2R-74-3362 dated <br /> 5 WHEREAS, the COUNTY establi <br /> 6 November 26, 1974, the Solid Waste Enterprise Fund to ensure <br /> 7 adequate resources for operating expenses for the COUNTY owned and <br /> 8 operated refuse disposal facilitiQs; and <br /> 9 WHEREAS, the COUNTY is responsible for the administration of <br /> 10 said fund; and <br /> 11 WHEREAS, the COUNTY has determined that projected net revenues <br /> 12 from said fund, derived from user fees charged for the use of the <br /> 13 COUNTY's solid waste facilities which include the Foothill Sanitary <br /> 14 Landfill (39-AA-0004) and the . Lovelace Transfer Station (39-AA- <br /> 15 0008) , during the thirty (30) year period of postclosure <br /> 16 maintenance of the LANDFILL, shall be greater during each year of <br /> e17 this period than the yearly_ monitoring and postclosure maintenance <br /> 18 costs contained in the most recent -cost estimate for the LANDFILL, <br /> 19 which has been submitted to the BOARD in accordance with Section <br /> e e <br /> 20 18266 of the _Regulations;. a <br /> u <br /> 21 NOW, <br /> FORE, the parties 'hereto mutually agree as follows: <br /> 22 1. The COUNTY hereby establishes a pledge of revenue as the <br /> financial mechanism for postclosure maintenance of the <br /> 23 <br /> with Sections 18283 and 18290 of <br /> 24 LANDFILL in accordance the <br /> 25 Regulations to replhce the LANDFILL's postclosure sub-budget <br /> 26 <br /> unit mechanism which was established to provide for <br />
