The COUNTY shall transfer funds that were previously dedicated <br /> 3 for postclosure maintenance of the LANDFILL in the Solid Waste <br /> 4 Closure .-Enterprise Fund to the sub-budget unit for- the <br /> 5 LANDFILL closure activities. <br /> 6 3 . The COUNTY agrees to pledge net revenues from the Solid Waste <br /> 7 Enterprise Fund as described herein. <br /> 8 4 . The amount of the pledged revenue shall be equal to the <br /> 9 approved postclosure maintenance cost of $116,080 per year for <br /> 10 the thirty (30) year period of postclosure maintenance, <br /> 11 representing the most recent monitoring and postclosure <br /> 12 maintenance cost estimate for the LANDFILL. It is .agreed that <br /> 13 the amount of this pledge .may increase or decrease to match <br /> 14 any, adjustment to the identified cost estimate which is <br /> 15 mutually agreed to by the* COUNTY and the BOARD. <br /> 16 5. If the COUNTY ceases at any time to retain control of its <br /> • I <br /> 17 ability to allocate the pledged revenue as identified herein <br /> 18 to pay postclosure maintenance costs, the COUNTY shall notify <br /> 19 the BOARD and the local enforcement agency and shall obtain <br /> 20 alternate coverage within sixty:-(60) -days after the control of <br /> 21 funds lapses, pursuant to Section .18290 of the Regulations: <br /> 22 6. In the event that the BOARD determines that the COUNTY has <br /> 23 failed, or is failing to perform postclosure maintenance as <br /> 24 required by law, the BOARD may.direct the Auditor-Controller <br /> 25 to pay from the pledged revenues such amounts as are necessary <br /> 26 to ensure sufficient postclosure maintenance, and such funds <br /> 27 shall be disbursed for postclosure maintenance in accordanc <br />
