Complaint Investigation Summary Report #: 5105 <br />COMPLAINT ID: C00054015 Site Location: 9999 S AUSTIN RD <br />Activity Summary <br />Activity Date <br /> <br />Recorded by <br /> <br />incident area in order to determine what the clean-up crew needs to begin the <br />clean-up on 7/9/2021, instead of today due to night-time safety concerns for the <br />clean-up crew. Requested Terry to give me a call once he is on-site and has <br />assessed the area. Terry agreed. <br />Began generating Notice To Abate. <br />At 1:48pm, called and spoke to Jason Torres, Metal Finishing Solutions <br />Operations Manager (209-990-9395) and informed him that I will be sending him <br />the Notice To Abate for this spill and EHD may be issuing the facility an in-office <br />inspection report for the illegal dumping of hazardous waste at the landfill. <br />Informed Jason that the EHD will need to be notified prior to the clean-up being <br />completed so that EHD can be on-site to verify the clean-up is complete. Jason <br />agreed. Emailed Jason (jtorres@mfinish.com) the Notice To Abate. <br />At 2:19pm, received a call from Terry stating the drums and containers are legally <br />empty and that tomorrow he plans to conduct the spill clean-up, and transport the <br />drums to a facility that recycles drums. Informed Terry that if any amount of <br />material can be poured out of a container, then the container is not considered <br />empty in California. Terry stated that the drums can release "drips." Informed <br />Terry again that if any amount can be poured out of the container, it is not <br />considered empty and a hazardous waste determination would need to be made <br />on the material. Terry stated he would consolidate the chemicals into seven <br />different containers according to each chemical's "chemistry." Informed Terry that <br />he must be careful not to mix incompatible materials. Terry confirmed that all of <br />the above regarding the clean-up would begin tomorrow morning and that EHD <br />would be informed prior to clean-up completion in order to verify the clean-up <br />on-site. <br />At 3:23pm received a call from Terry stating he excavated the spill area and <br />placed the soil into plastic bags, and that he lined the drums and containers up <br />according to each container's chemistry in a different area in between two heavy <br />pieces of equipment. Terry stated he excavated a1ftx1ftx6 inch area where <br />the spill occurred near the drums and another 1 ftx1 ftx6 inch area in the decon <br />area. Terry stated the soil and a crushed sodium hydroxide drum, which Terry <br />stated was the drum buried beneath garbage, will be placed in an over-pack drum <br />and disposed of as hazardous waste on a uniform hazardous waste manifest. <br />Terry also stated that the sixty-two 5-gallon containers were for a material called <br />Gardobond. Terry stated he would provide the safety data sheet for each material <br />in the drums and containers. Terry stated the materials in the drums and <br />containers still need to be consolidated into seven different containers according <br />to each material's chemistry. Reminded Terry that he was supposed to call me <br />before he began excavation so that I could be on-site. Requested Terry to send <br />me photos of the excavated area and the containers. Terry agreed to send me <br />photos. <br />At 3.37pm Terry called me stating that the landfill has buried the excavation area <br />with garbage. Called and left a message for Ruben Ramirez.
