I <br /> 1 6. 12 ADDITIONAL ENFORCEMENT ACTIONS j <br /> 2 All requirements contained in this Order are in addition to the <br /> 3 '; requirements contained in the Settlement Agreement of 1984 <br /> I <br /> 4between the Marley Cooling Tower Company, the Department of <br /> 5II Health Services, and the Central Valley Regional Water Quality <br /> 61 Control Board. <br /> 7l 6 . 13 SETTLEMENT AGREEMENT <br /> I <br /> 8 Except as otherwise provided by the Order or by provision of <br /> 9 law, the parties' respective rights and obligations as set <br /> 10 forth in the 1984 Settlement Agreement remain in full force and <br /> 11 effect, and continue to apply to Respondent' s activities at the <br /> 12 Site. In particular, any dispute under this Order or the 1984 <br /> 13 Settlement Agreement shall be addressed under the dispute <br /> 14 resolution procedure contained in Article VI of the 1984 <br /> 15 Agreement. In the event of any apparent conflict between the <br /> 16 Settlement Agreement and this Order, this Order shall prevail . <br /> 17 The schedule for future work to be performed the Site will be <br /> 18 governed by Exhibit F of this Order. <br /> 19 6. 14 COMPLIANCE WITH APPLICABLE LAWS <br /> 20 Respondent shall carry out this Order in compliance with all <br /> 21 applicable local, State, and Federal requirements, including, <br /> 22 but not limited to, requirements to obtain permits and to <br /> 23 assure worker safety. <br /> 24 6. 15 GOVERNMENT LIABILITIES <br /> 25 The State of California shall not be liable for any injuries or <br /> 26 damages to persons or property resulting from acts or omissions <br /> 27 by Respondent, its officers, directors, employees, agents, <br /> -38- <br /> COURT PAPER <br /> STATIC OFCALI/0111111 <br /> STO.
