SWIS number 39-CR-0022 was assigned to the disposal area (disposal <br />site) determined at that time to be a portion of parcels 198-120-08 (500 East Louise Ave) <br />and 198-120-09 (17100 Murphy Parkway), and all of the subject property parcel <br />198-120-05 (17200 Murphy Parkway). Historical aerial photos are presented in <br />Appendix B that depict potential former waste pile areas and the approximate disposal <br />site area of 39-CR-0022. <br /> <br />The former LOF/PNA facility contained unpermitted landfill cells that resulted in discharge <br />of wastes and the COCs. Two primary waste cells reported as the North Waste Cell <br />(NWC) and South Waste Cell (SWC) were assessed and remediated up to what was <br />thought to be the boundary of the cogeneration parcel. At the time of remediation, the <br />property boundary was estimated and not established by licensed surveyors. <br />Investigations performed at the subject property in 2019 and 2020 determined that both <br />waste cells continued onto the subject property (Waste Cell No. 1 and 1A), along the East <br />Property Boundary (AOC1). The investigations also identified two waste cells beneath the <br />Facility (AOC2; Waste Cell No. 2 and 2A). The waste cells are composed of glass <br />processing waste and not glass cullet waste. <br /> <br />Between 1990 and 2013, a gas fired power plant operated in the northern portion of the <br />Site (Facility). The Facility was shut down in 2013 and demolished in 2017. The Facility <br />was enclosed by a berm and chain link fence and was adjacent to vacant land in each <br />direction during operation. The surface elevation of the Facility was approximately 3.5 to <br />5.0 feet higher than the surrounding area. The Facility was shut down in 2013 and did not <br />operate again before it was demolished in 2017. During this time, the property was <br />believed to be owned and operated by Dominion Resources, Destec/Dynergy, El Paso <br />Energy, and MDU Resources. In 2007, the power plant was acquired by Bicent Power <br />LLC which was renamed to Heorot Power Holdings LLC (HPH) in 2012. According to San <br />Joaquin County Assessor information, the property is currently owned by San Joaquin <br />Cogen, LLC ETAL. <br /> <br /> <br />2.3. SURROUNDING LAND USE <br /> <br />The subject property is located in a commercial and industrial area of Lathrop, California. <br />The Site is bordered to the west by vacant land listed for industrial use, and to the north, <br />south and east by commercial buildings and property utilized for both commercial and <br />industrial use. The former LOF/PNA facility is located to the north, a large commercial <br />warehouse building utilized by Tesla is located to the east, and logistical distribution <br />centers are located to the south. Retail and distribution operations are located further to <br />the west and northwest, beyond the empty lots adjacent to the Site, and Interstate 5 is <br />located approximately 1,500 feet to the west. The northern edge of the Site includes a set <br />of railroad tracks which run east to west but are no longer in use. East Louise Avenue is <br />located approximately 1,600 feet to the north followed by residential neighborhoods.
