d. Demolition of any abandoned structures and removal of all demolition material from the premises to an approved landfill is required in accordance with San Joaquin County Ordinance Code Section 5-2401. e. Any existing well must be destroyed under permit and inspection by the Environmental Health Division. f. Connect to an approved public water supply system as required by Development Title Section 9-1120.2- 9. -1120.2g. Mandatory garbage service is required for residences in the new subdivision. 4. COUNTY COUNSEL a. Pursuant to Section 66474.9 of the Govvemment Code, the subdivider shall defend, indemnity,and hold harmless the local agency or its agents, officers,and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body conceming a subdivision, which action is brought within the time provided for in Section 66499.37 of the Government Code. 5. DEPARTMENT OF PARKS AND RECREATION: (Contact: Jeff Smith, 953-8800) a. A San Joaquin County approved mechanism to provide funding for the on-going maintenance of the facilities shall be established. b. The design of the drainage basin/park shall allow for equal joint use of the facilities and shall not relegate the parks and recreation use to a position of lesser importance. C. The park development plans shall be submitted for review and approval by the San Joaquin County Department of Parks and Recreation. d. All proposed parks and recreation equipment shall be submitted by the developer for approval by the San Joaquin County Department of Parks and Recreation. e. Park construction shall be irmpected by the San Joaquin County Department of Parks and Recreation to ensure compliance with the approved construction documents. f. The developer shall reimburse the San Joaquin County Department of Parks and Recreation, on a time and materials basis, for all costs for time spent to review the plans and inspect the construction. g. The San Joaquin County Department of Parks and Recreation reserves the right to refuse the proposed park land and elect to take in-lieu fees if any of these conditions are not met. h. The San Joaquin County Department of Aging shall be the approving agency for the proposed community center to ensure compliance with their program needs.
