d. Demolition of any abandoned structures and removal of all demolition material from the <br /> premises to an approved landfill is required in accordance with San Joaquin County <br /> Ordinance Code Section 5-2401. <br /> e. Any existing well must be destroyed under permit and inspection by the Environmental <br /> Health Division. <br /> f. Connect to an approved public water supply system as required by Development Title <br /> Section 9-1120.2- <br /> 9. <br /> -1120.2g. Mandatory garbage service is required for residences in the new subdivision. <br /> 4. COUNTY COUNSEL <br /> a. Pursuant to Section 66474.9 of the Govvemment Code, the subdivider shall defend, <br /> indemnity,and hold harmless the local agency or its agents, officers,and employees from <br /> any claim, action, or proceeding against the local agency or its agents, officers, or <br /> employees to attack, set aside, void, or annul an approval of the local agency, advisory <br /> agency, appeal board, or legislative body conceming a subdivision, which action is <br /> brought within the time provided for in Section 66499.37 of the Government Code. <br /> 5. DEPARTMENT OF PARKS AND RECREATION: (Contact: Jeff Smith, 953-8800) <br /> a. A San Joaquin County approved mechanism to provide funding for the on-going <br /> maintenance of the facilities shall be established. <br /> b. The design of the drainage basin/park shall allow for equal joint use of the facilities and <br /> shall not relegate the parks and recreation use to a position of lesser importance. <br /> C. The park development plans shall be submitted for review and approval by the San <br /> Joaquin County Department of Parks and Recreation. <br /> d. All proposed parks and recreation equipment shall be submitted by the developer for <br /> approval by the San Joaquin County Department of Parks and Recreation. <br /> e. Park construction shall be irmpected by the San Joaquin County Department of Parks and <br /> Recreation to ensure compliance with the approved construction documents. <br /> f. The developer shall reimburse the San Joaquin County Department of Parks and <br /> Recreation, on a time and materials basis, for all costs for time spent to review the plans <br /> and inspect the construction. <br /> g. The San Joaquin County Department of Parks and Recreation reserves the right to refuse <br /> the proposed park land and elect to take in-lieu fees if any of these conditions are not <br /> met. <br /> h.
