81. The developer shall, when required by the CSD General Manager, offer for dedication to <br /> the CSD an adequate Materials Recovery Site, currently estimated to be ten acres, within <br /> the 50-acre site designated for Public uses in the Old River Industrial Park. <br /> 82. Electrical transformers within residential neighborhoods shall be in underground vaults, <br /> subject to CSD and Modesto Irrigation District(MID) requirements. The developer shall <br /> pay for any incremental costs relating to undergrounding transformers not paid for by <br /> MID. Transformers located in the downtown area, commercial and industrial areas may <br /> be placed above ground provided they are aesthetically designed and/or shielded by <br /> landscaping subject to CSD and MID requirements. [MP8.6.1 b), polices 8.5 e,f), <br /> implementation 8.2 d), SPI 8.1.1] <br /> WASTEWATER TREATMENT PLANT <br /> 83. Prior to the recording of the first Final Map or the final acceptance of the wastewater <br /> treatment plant by the CSD, whichever comes first, the agreement for wastewater effluent <br /> disposal on Trimark lands shall be fully executed between the CSD and Trimark and <br /> recorded at the County Recorder's Office. <br /> 84. Prior to the recording of the first Final Map or the final acceptance of the wastewater <br /> treatment plant by the CSD, whichever comes first, Trimark Communities shall submit <br /> and have the CSD approve a "Plan of Action" report that describes how Trimark <br /> Communities plan to address the conditions in Discharge Permit Order No. 98-192 issued <br /> by the Regional Water Quality Control Board. The report shall also include a critical <br /> path time schedule. <br /> 85. Based on current CSD Development Standards, it has been determined that full build out <br /> of the land uses shown on the Tentative Map will generate an average wastewater flow of <br /> approximately 0.530 mgd. When the initial phase of the wastewater treatment plant is <br /> completed and operational, the plant capacity will be approximately 0.225 mgd. Phased <br /> development of the land shown on the Tentative Map may proceed only if there is <br /> capacity available for the entire phase, after deducting the capacity allocation for any <br /> previous phase. As development occurs, the CSD will monitor wastewater flows and <br /> make periodic assessments as to the accuracy of the previous wastewater generation <br /> projections, and make adjustment in the wastewater generation factors as deemed <br /> appropriate by the General Manager. Such assessments could cause a change in the <br /> number of Equivalent Dwelling Units (EDU's) that would ultimately be allowed to hook <br /> up to the wastewater collection and treatment system. <br /> Subject to the terms and conditions of the Master Acquisition and Reimbursement <br /> Agreement, prior to the approving the first Final Map,the developer shall propose and <br /> the CSD shall adopt a legal description or a designation of lot numbers of that portion of <br /> the Tentative Map that is to be allocated both the initial approximate 0.225 mgd and the <br /> approximate expanded 0.450 mgd capacities of the wastewater treatment plant. The land <br /> area being described shall be the Sewer Capacity Service Area for the initial plant <br /> capacity. Supporting the described area, the developer shall provide flow calculations <br /> that verifies that the design wastewater generated by the land uses proposed within the <br /> 10/05/00 17 <br />
