Wastewater generation rates shall be as <br /> described in the CSD Development Standards. <br /> All proposed land uses within the Neighborhood F Tentative Map boundary shall be <br /> within the Sewer Capacity Service Area before the service area boundary is allowed to <br /> extend beyond the Tentative Map boundary. <br /> If, during the course of the phased development of Neighborhood F, phasing plans should <br /> change, to accommodate this change revisions to the Sewer Capacity Service Area <br /> boundary or lots designated for service may be made by the developer upon request to the <br /> CSD. <br /> Nothing in this condition is intended nor shall it modify or change any right or obligation <br /> created by the Master Acquisition and Reimbursement Agreement. <br /> 86. No building permit shall be issued for any phase of Neighborhood F prior to the CSD <br /> accepting the wastewater treatment facilities for operations and maintenance. <br /> 87. Trimark shall obtain an exemption for the State for the proposed Water Storage Reservoir <br /> Dams (Reservoirs I and 1B) prior to the CSD accepting any phase of the treatment <br /> plant facilities construction that includes one of the reservoirs. The CSD will cooperate <br /> with Trimark in securing an exemption. <br /> 88. Prior to the recording of the first Final Map or the final acceptance of the wastewater <br /> treatment plant by the CSD, whichever comes first, the CSD and Trimark Communities <br /> shall have fully executed an agreement, pursuant to the Wastewater Effluent Easement <br /> Agreement, that clearly defines the relationship between the CSD (the authority in <br /> control of disposing of plant effluent on land) and Trimark Communities (the owner of <br /> the land set aside for effluent disposal). <br /> WATER TREATMENT PLANT <br /> 89. Subject to the terms and conditions of the Master Acquisition and Reimbursement <br /> Agreement,prior to the recording of the first Final Map, the developer shall propose and <br /> the CSD shall adopt a legal description of that portion of the Tentative Map that is to be <br /> allocated the initial capacity of the water treatment plant. The land area being described <br /> shall be the Water Capacity Service Area for the initial plant capacity. Supporting the <br /> described area, the developer shall provide flow calculations that verifies that the design <br /> water generated by the land uses proposed within the described area does not exceed the <br /> plant capacity. Water demand rates shall be as described in the CSD Development <br /> Standards. <br /> It is expected that the capacity of the initial phase of the water treatment plant will exceed <br /> the demand requirements of Neighborhood F. In this case the legal description of the <br /> Water Capacity Service Area will extend beyond the boundary of that of Neighborhood <br /> F. The developer, in a manner described above, shall define the additional area beyond <br /> the boundary of Neighborhood F. Any additional area shall be within the boundary of the <br /> CSD and shall be contiguous with the boundary of Neighborhood F. <br /> 10/05/00 18 <br />
