II.E. Finding: Upon approval of the Neighborhood F Project, the County will file a <br /> notice of determination. <br /> CEQA Requirements: Section 15177 (e) of CEQA states: When the lead agency <br /> approves a project pursuant to this section, the lead agency shall file a notice in the <br /> manner required by Section 15075. CEQA Guidelines Section 15075(a) states: After. <br /> deciding to carry out or approve a project for which a negative declaration or mitigated <br /> negative declaration has been approved, the lead agency shall file a notice of <br /> determination. <br /> San Joaquin County will file a Notice of Determination after the Mitigated Negative <br /> Declaration is approved by the San Joaquin County Board of Supervisors. <br /> ILF. Finding: The County prepared an Initial Study and Mitigated Negative Declaration <br /> and finds that the cumulative impacts, growth inducing impacts and irreversible <br /> significant effects analyses in the 1994 Master EIR is adequate for the Neighborhood F <br /> Project. <br /> CEQA Requirements: CEQA Guidelines Section 15178 (a) states: When a proposed <br /> subsequent project is identified in the Master EIR, but the lead agency cannot make a <br /> determination pursuant to Section 15177 that the subsequent project is within the scope <br /> of the Master EIR, and the lead agency determines that the cumulative impacts, growth <br /> inducing impacts and irreversible significant effects analysis in the Master EIR is <br /> adequate for the subsequent project, the lead agency shall prepare a mitigated negative <br /> declaration or a focused EIR if, after preparing an initial study, the lead agency <br /> determines that the project may result in new or additional significant effects. Whether <br /> the cumulative impacts, growth inducing impacts or irreversible significant effects <br /> analyses are adequate is a question offact to be determined by the lead agency based <br /> upon a review of the proposed subsequent project in light of the Master EIR. <br /> Statement of Fact: The cumulative impacts, growth inducing impacts and irreversible <br /> significant effects analyzed in the 1994 Master EIR are still applicable to the proposed <br /> subsequent project,Neighborhood F Project. The cumulative analysis in the 1994 Master <br /> EIR addressed cumulative impacts in various ways, depending on the topic. For some <br /> topics, specific projects within a 30-mile radius of the Mountain House site were <br /> addressed, and a list of 34 cumulative projects was prepared (see Table 6.1 of 1994 <br /> Master EIR). In addition, the cumulative analysis addressed in Chapter 6 of the 1994 <br /> Master EIR addressed the County's General Plan which addresses growth to 2010. This <br /> General Plan has not been updated or significantly amended since the 1994 Master EIR <br /> was prepared. While some of the cumulative projects identified in the 1994 Master EIR <br /> have been withdrawn or completed, other projects have been proposed since the original <br /> 11 <br />
