In the alternative, if it is concluded that the 1994 Master EIR did not address these more <br /> specifically discussed significant environmental effects, additional mitigation measures <br /> and alternatives,then the County finds that a mitigated negative declaration is authorized <br /> by Section 15178(b). According to the Initial Study, these significant environmental <br /> effects are not significantly different or greater than the significant environmental effects <br /> addressed in the 1994 Master EIR, but because they are more precise (in relationship to <br /> the specificity of the requested land use approvals) the form of mitigation is <br /> correspondingly more detailed and precise. <br /> These feasible mitigation measures are incorporated into the project, as approved and <br /> agreed to by the project applicant. Appendix B of the Initial Study includes a"Consent <br /> Agreement for Mitigation Measures Proposed in Mitigated Negative Declaration" which <br /> is signed by the project applicant effectively amending the project to incorporate the <br /> mitigation measures prior to the release of the mitigated negative declaration for public <br /> review. <br /> H.H. Finding: The County prepared an Initial Study and Mitigated Negative Declaration <br /> and finds that a focused EIR is not necessary for the Neighborhood F Project. <br /> CEQA Requirements: CEQA Guidelines Section 15178 (c) states:A lead agency shall <br /> prepare a focused EIR if the subsequent project may have a significant effect on the <br /> environment and a mitigated negative declaration pursuant to subdivision (b) of this <br /> section cannot be prepared. <br /> Statement of Fact: The County finds that any potentially new or additional significant <br /> environmental effects identified in the Initial Study, if there are any, are mitigated by <br /> incorporating feasible mitigation measures into the revised project. As such, a Mitigated <br /> Negative Declaration is prepared. <br /> ILL Finding: Upon approval of the Neighborhood F Project,the County will file a <br /> notice of determination. <br /> CEQA Requirements: CEQA Guidelines Section 15178 (d) states:A lead agency shall <br /> file a notice of determination shall be filed(sic)pursuant to Section 15075 if a project <br /> has been approved for which a mitigated negative declaration has been prepared <br /> pursuant to this section. <br /> Statement of Fact: San Joaquin County will file a notice of determination after approval <br /> of the Neighborhood F Project. <br /> H.J. Finding: The County prepared an Initial Study and Mitigated Negative Declaration <br /> and finds that cumulative impacts, growth inducing impacts and irreversible significant <br /> effects analyses in the 1994 Master EIR is adequate for the Neighborhood F Project. <br /> 14 <br />
