the Lammersville School. High school students would be required to attend interim high school <br /> facilities, also to be funded by Trimark, at the Tracy Union West High School to the southeast of <br /> the proposed project. <br /> As part of the Wicklund School construction, a parcel of land for childcare facilities would <br /> dedicated to the Lammersville School District by Trimark. Although Trimark would not be <br /> responsible for the construction of the day care facility or its operation, Trimark would take an <br /> active part in its marketing. The specific language of the Development Agreement between the <br /> County and Trimark concerning the childcare site is as follows: <br /> In addition [to the policies, objectives, implementation and project requirements of the <br /> Master Plan concerning childcare facilities], Developer[Trimark] agrees to actively market <br /> the first day care site located in Neighborhood "F" and provide County with evidence of <br /> these marketing efforts. If a day care facility is not developed by the time the first <br /> elementary school is opened, then Developer shall meet and confer with the CSD, County <br /> and Lammersville Elementary School district to examine methods to market the land to <br /> day care operators. Notwithstanding any provision of this Agreement, Developer shall not <br /> be obligated to dedicate additional land, construct or subsidize construction of or operate <br /> or subsidize operations of any day care facility within the Community. <br /> 8. Public Health and Safety Services <br /> Urban levels of fire protection and emergency services would be provided by the CSD through <br /> contract with the Tracy Fire Department. Per requirements of the CSD, Trimark will be funding <br /> and possibly constructing on behalf of the CSD the fire station noted above (see 5. <br /> infrastructure: fire station) <br /> Police services would be provided by the County's Sheriff Department under contract to the CSD. <br /> An urban level of police service is to be provided from the commencement of construction. <br /> Specifically, in accordance with Master Plan policies, sworn officers are to be provided at a ratio of <br /> 1.5 officers per 1,000 residents. By the time the proposed project is built out, there would be a <br /> total of six sheriff deputies providing police services. <br /> Ambulance services would be provided by the CSD through a contract with service agencies. <br /> Library and animal control services would also be provided by the CSD through contract <br /> arrangements with the County or other jurisdiction. Until the population in the proposed project <br /> necessitates the construction of a full-service branch library, bookmobile services and interim <br /> leased library facilities would be provided. Animal control services and facilities would be provided <br /> on an interim basis also, until the CSD determines that the provision of long term on-site facilities <br /> is feasible. All other public services would be provided by the CSD. <br /> 9. Waste Management <br /> The CSD would be providing, through contract with providers, all waste management services for <br /> the proposed project. The CSD is currently in discussions with potential providers. Within the <br /> overall 50-acre public site in the Old River Industrial Park area, Trimark would make sufficient land <br /> available to the CSD for waste transfer and composting functions. <br /> 10. Adjacent Agricultural Operations, Buffers & Community Edges <br /> Trimark owns and leases all agricultural fields adjacent to the proposed project, except for the <br /> adjacent dairy operations to the south. The agricultural operations to the west and north of the <br /> proposed project are operated year round, where a combination of corn, sugar beets and alfalfa <br /> -11- <br />
