Financing Plan was approved to ensure that, as development commences in the Community, <br /> mechanisms are in place to implement the objectives of the Public Financing Plan. The <br /> Neighborhood F project will be subject to the impact fees, monthly charges and special taxes that <br /> have been and will be adopted to provide for the funding of public facilities and services required <br /> to serve the new development. Specifically, Neighborhood "F" is consisent with the Public <br /> Financing Plan due to the following: <br /> 1. Development within Neighborhood F will finance the full cost of infrastructure needed to serve <br /> the neighborhood, through a combination of impact fees, monthly utility charges, Mello-Roos <br /> special taxes and CSD special taxes. <br /> 2. Development within Neighborhood F will pay the cost of mitigating impacts on existing <br /> facilities, infrastructure and the environment and will support development of affordable <br /> housing through the payment of a variety of impact fees. <br /> 3. Infrastructure costs were allocated to properties within Neighborhood F based on the principle <br /> of benefit received. <br /> 4. Mechanisms have been established to assure timely construction of public improvements, <br /> dedication of necessary public lands and rights-of-way, and reimbursement of <br /> disproportionate costs. <br /> 5. The revenues generated to the County of San Joaquin from development of Neighborhood F <br /> will offset the cost of public services to ensure that the project has a positive fiscal impact on <br /> the County. <br /> Development Title Consistency. The Development Title consistency analysis found that the <br /> proposed project is consistentwith the San Joaquin County Development Title,which includes the <br /> Mountain House Development Title as an addendum,as conditioned to address the areas described <br /> below. <br /> Noise. The Mountain House Neighborhood "F"Project Initial Study,SCH#90020776 states that, to <br /> achieve an outdoor sound level of 60 dB Ldn along Mascot Boulevard and De Anza Boulevard, <br /> sound walls in excess of 7 feet in height would be required. Concerning this 60 dB Ldn threshold, <br /> Section 9-1025.9M (b)(2) of the Mountain House Development Title specifies the following: <br /> Noise levels from mobile noise sources in primary outdoor use areas of new residential <br /> development shall not exceed an LDN of sixty (60) dB unless the project design includes <br /> mitigation measures to reduce noise in outdoor activity areas to sixty (60) dB, or as <br /> reasonably close to sixty (60) dB as is possible. Where it is not possible to reduce noise <br /> in outdoor activity areas to an Ldn of sixty (60) dB or less, an exterior noise level of up to, <br /> but not exceeding, an Ldn of sixty-five (65) dB may be allowed by the Review Authority. <br /> Sound walls that exceed 7 feet in height would exceed the 7 foot height limit of the County's <br /> Development Title (see Section 9-1022.2 (c)(2)). In addition, the Development Title does not <br /> permit the construction of the 7-foot (or higher) sound walls located at the entries to Tradition <br /> Street and Prosperity Street from Mascot Boulevard, as indicated in Figure 4 of this staff report, <br /> since they provide fencing for the street side yard of residential lots. Section 9-1022.2 (c)(1) limits <br /> fencing height in street side yards to 3 feet. This requirement may be overridden if the fence is <br /> located a minimum of 10 feet from the property line (see Section 9-1022.3 (c)(2)). An amendment <br /> to the Master Plan and either an accompanying amendment to, or variance from, the <br /> Development Title height requirement would be required if 7 foot walls are to be constructed along <br /> street side yards. <br /> -22- <br />
