This finding can be made since analysis shows that the proposed project reflects the <br /> location of public lands required by the Master Plan and Specific Plan I and satisfies its <br /> PLEP,fair-share acreage requirement.As noted in the project description,the amount <br /> of total onsite and offsite public lands required for the proposed project actually exceeds <br /> its PLEP,fair-share acreage requirement. <br /> 2. The amount and location of public lands on the subject parcel are acceptable to the <br /> public agencies that are to receive such lands. <br /> This finding can be made since the CSD and the Lammersville School District have <br /> indicated their intention to accept these public lands. <br /> Development Agreement Consistency <br /> The Master Plan DevelopmentAgreementBy and Between the County of San Joaquin and Trimark <br /> Communities(the"Development Agreement")requires the County to make additional <br /> determinations before approving a "subsequent discretionary approval'—the Major Subdivision <br /> application for Mountain House Neighborhood Tract"F", Unit#2 (Tract 2925 ). In compliance with <br /> this requirement, the County has found that the following determinations can be made: <br /> 1. Tract 2925(also referred to as the"Map")is within the Specific Plan I area. <br /> 2. The CSD has been formed and (a)the County and CSD have executed a PSA agreement which <br /> includes developmentof the real property subject to the Map; and (b)Trimark Communities and <br /> the CSD have executed an agreement providing for infrastructure and urban services to be <br /> provided in connection with the proposed development of the real property. <br /> 3. The real property subject to the Map is subject to the DevelopmentAgreement. <br /> 4. As found at Finding 2 of the Development Agreement,the Map is consistent with the policies, <br /> goals , standards and requirements of the Existing Approvals(as the term is defined in the <br /> Development Agreement), <br /> 5. All transfers of land, owned or controlled by Trimark,which are specified by the Existing <br /> Approvals(as defined in the De velopmen t Agreement) as being necessary for public purposes <br /> have been transferred to the appropriate public agency. <br /> 6. The Map meets or exceeds the job-to-housing program and affordable housing program of the <br /> Master Plan. <br /> 7. All documents and agreements have been completed and approved,to the extent applicable <br /> pursuant to the Development Agreement. <br /> 8. As explained by the CEQA findings for Neighborhood F, environmental review of the Map has <br /> been completed and appropriate mitigation measures required as a result thereof have been <br /> included in the approval to the extent feasible. <br /> CSD Subsequent Plans and Programs Consistency <br /> The CSD has approved a series of plans and approvals concerning the proposed project. These <br /> plans and approvals are listed in Exhibit D of the Development Agreement and are referred to as the <br /> CSD Subsequent Plans and Approvals.
