At the time of the Map application, the applicant is in compliance with and <br /> participating in as required the plans and programs being carried out under the Existing <br /> Approvals (as that term is defined in the Development Agreement). <br /> 91. All transfers of land, owned or controlled by Trimark, which are specified by <br /> the Existing Approvals (as defined in the Development Agreement) as being necessary <br /> for public purpose have been transferred to the appropriate public agency. <br /> 9.G. The Map meets or exceeds the job-to-housing program and affordable <br /> housing program of the Master Plan. <br /> 9.H. All documents and agreements have been completed and approved, to the <br /> extent applicable pursuant to the Development Agreement. <br /> 9.I. As explained by the CEQA findings for Neighborhood F, environmental <br /> review of the Map has been completed and appropriate mitigation measures required as a <br /> result thereof have been included in the approval to the extent feasible. <br /> LOTS DESIGNED FOR SECOND UNITS HAVE BEEN LOCATED AND SIZED <br /> TO ACCOMMODATE SUCH SECOND UNITS <br /> 10. The Map includes lots that will include second units. The County Planning <br /> Department staff has reviewed the lots that will receive second units and concluded in <br /> their professional opinion that these lots have been appropriately located and sized to <br /> accommodate the second unit dwellings. In making their independent judgment, the <br /> County determines that it is reasonable to rely on the professional opinion of the County <br /> Planning Department. <br /> STRUCTURES ON THE PROPOSED MAP LOTS CAN BE ORIENTED TO <br /> TAKE ADVANTAGE OF SOLAR ORIENTATION <br /> 11. According to the County Planning Department staff structures to be constructed on <br /> lots created by the Map can be oriented to take advantage of a solar orientation. The <br /> County finds that it is reasonable to rely on the professional opinion of the County <br /> Planning Department staff in finding that, in the County's independent judgment, the <br /> Map is designed to have the right to receive sunlight. <br /> THE MAP IS CONSISTENT WITH THE ADOPTED FINANCING PLAN <br /> 12. The Neighborhood F project is consistent with the Public Financing Plan that was <br /> approved by the Board of Supervisors in December 1994 for the Mountain House <br /> Community. The Master Plan requires that each discretionary Development Permit <br /> approval be consistent with the Public Financing Plan. The Mountain House Public <br /> 5 <br />
