1. COMMUNITY DEVELOPMENT DEPARTivIENT <br /> b. DEVELOPMENT: A notice of Subdivision Restriction shall be placed on the Final Map and <br /> recorded as a separate instrument that restricts the development of the subdivided lots and the <br /> designated remainder until they are further subdivided. Compliance: This required notice will <br /> be placed on the Final Map for Tract 2924. The subject subdivision request, Tract 2925 also <br /> serves to satisfy this condition in that Tract 2925 further subdivides Tract 2924 into buildable lots. <br /> c. A note shall be included on the Final Map stating that all requirements specified in Exhibit"D" of <br /> the tifountain House Development Agreement, the Master Plan, and Specific Plan I that are to be <br /> fulfilled prior to the first Development Permit shall be satisfied before an additional subdivision or <br /> development can occur on parcels shown on the Final map, unless waived by the Board of <br /> Supervisors. At the time the lots are resubdivided, additional conditions may be imposed to <br /> reflect development conditions, pattern and density. Compliance: Section 10 of this Binder <br /> included copies of Letters of Completion from the County demonstrating the satisfaction of all but <br /> one item listed in Development Agreement Exhibit"D". The remaining required item,the"CSD <br /> Services Agreement", anticipated to be adopted in January of 2000, was waived by the Board of <br /> Supervisors as a"prior to first development permit"item in September of 1999. One other item <br /> require by the Master Plan(M.P. 12.12) prior to first development permit is the preparation of a <br /> Farm Irrigation and Drainage Impact Study. This study is included in Section 12 of this Binder. <br /> o. Agricultural Buffer: All Tentative Map submittals that are adjacent to a Specific Plan boundary, <br /> and specifically those adjacent to agricultural operations, shall contain measures to minimize <br /> conflicts. These measures shall include any combination of setbacks, buffers, and landscape <br /> treatment that can effectively reduce potential conflicts. These measures may be interim or <br /> designed to be incorporated into the ultimate community design. Compliance: The Tentative <br /> Tract Map application includes a specific sheet along with the subdivision design which addresses <br /> the various community edge requirements for development of Neighborhood F. The provisions <br /> include the installation of the landscape buffer located along Mountain House Parkway, and the <br /> setback of on-going farm operations around the perimeter of the Neighborhood Boundary which <br /> vary between a minimum of 100 feet to as much as 1000 feet. Please see Section 4 of this Binder <br /> to see the diagram. <br /> 2. MOUNTAIN HOUSE COMMUNITY SERVICES DISTRICT <br /> a. A note shall be placed on the Final Map stating that if development impact fees for sewer and/or <br /> storm drain facilities are required, such fees shall. at least 30 days prior to the submittal of the <br /> "small lot" Tentative Map for Neighborhood F, be adopted by the MHCSD and by San Joaquin <br /> County, if applicable, in accordance with Subdivision Map Act Section 66483; and prior to <br /> approval of the "small lot" Tentative Map for Neighborhood F, all other required fees shall be <br /> adopted. Compliance: Pursuant to the recently approved "Financial Implementation Plan' <br /> (approved by the Board of Supervisors on December 7, 1999),no impact fees for sewer or storm <br /> drain are to be adopted for the project, but rather user charges will be levied against all future <br /> properties with the community by the MHCSD. Further, the anticipated impact fees including <br /> _the CSD Facilities Fee, and Local Road Impact Fee (addressing roads, parks, and other <br /> maintenance facilities) are currently being drafted and are anticipated to be adopted by the <br /> MHCSD prior to Planning Commission action on the Tentative Tract Map for Tract 2925. <br /> b. Prior to approval of the "small lot" Final Map for Neighborhood F, or any construction of the <br /> improvements, the infrastructure master plans or any revision shall be approved by the MHCSD. <br /> Such plans shall include, but not be limited,master storm drainage and flood control plan, water <br /> distribution and treatment plan, sanitary sewer collection and treatment plan, master <br /> infrastructure plan, development standards of MHCSD, and other plans needed for orderly <br /> development of infrastructure to provide services to the Mountain House community. <br /> Compliance: The Master Sewer Distribution Plan was adopted by the MHCSD Board in May <br /> 1999.
