Per Douglas Burns, Owner, it will <br /> be replaced.The spill kit are not observed on site. Per Justin &Douglas Burns,they will replace the spill kit. <br /> REGULATION GUIDANCE:All facility communications or alarm systems,fire protection equipment, spill control <br /> equipment, and decontamination equipment,where required, shall be tested and maintained as necessary to assure <br /> its proper operation in time of emergency. <br /> CORRECTIVE ACTION: Bring the spill kit and fire extinguisher into proper working order by replacement. Provide <br /> a corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a Class II violation. <br /> 502 CCR 66265.192(a) Failed to comply with new hazardous waste tank system assessment requirements. <br /> OBSERVATION: This facility has hazardous waste tanks but no tank assessment documents.A 480 gallon used oil <br /> tank was observed inside the hazardous waste storage area. Per Douglas Burns,they did not know that an tank <br /> assessment was needed. <br /> REGULATION GUIDANCE: <br /> Title 22 California Code of Regulations section 66270.11 Signatories to Permit Applications and Reports <br /> Title 22 California Code of Regulations section 66260.10 Definitions <br /> "Tank"means a stationary device, designed to contain an accumulation of hazardous waste which is constructed <br /> primarily of nonearthen materials(e.g.,wood, concrete, steel, plastic)which provide structural support. <br /> Title 22 California Code of Regulations section 66265.192 Design and Installation of New Tank Systems or <br /> Components. <br /> Title 22 California Code of Regulations section 66265.193 Containment and Detection of Releases <br /> CORRECTIVE ACTION: Have a qualified Professional Engineer prepare a tank assessment for each tank. <br /> Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental <br /> Health Department(EHD)within 30 days.
