the benchmarks shall be used to determine settlement/consolidation of fill materials in <br /> closed sections of the landfill and after significant seismic events (earthquake event <br /> having a Modified Mercalli intensity of V or greater at the landfill). <br /> i. Temporary plantings, geofabric drapes, and erosion preventing diversions of surface <br /> water shall be constructed as needed on temporary slopes. <br /> j. A speed limit of`M miles per hour or less shall be posted and enforced for all unpaved <br /> surfaces. <br /> k. If requested by the owner of the property at 9690 South Austin Road, a five-foot-high <br /> sound wall shall be constructed at that site. If the request is not received within five years <br /> of the date of approval, this condition shall become void. <br /> 1. Litter from this facility tends to be blown across Austin Road onto the fields to the east. <br /> Such litter shall be collected daily. Regularly scheduled inspections shall be conducted <br /> to control litter at the entrance facilities and at the transfer station. Forward Inc. shall <br /> collect and deposit on-site litter on a daily basis. Portable litter collection fences shall be <br /> installed as necessary to prohibit wind-blown litter from accumulating along roadways or <br /> around buildings. <br /> M. The applicant shall comply with the attached Mitigation Monitoring Program. The <br /> applicant and the Community Development Department shall annually review the <br /> program. Not less that 30 days nor more that 60 days prior to the first anniversary date <br /> of this approval, and each anniversary date thereafter, the applicant shall submit to the <br /> Community Development Department a letter setting forth the applicant's good faith <br /> compliance with the terms and conditions of the program. Community Development <br /> Department staff will visit the site semi-annually. All costs incurred by the Community <br /> Development Department for the semi-annual monitoring and the annual review shall be <br /> bome by the applicant. The costs may include costs of Community Development <br /> Department staff and administrative time and direct out-of-pocket costs and expenses, <br /> including costs of consultants and non-department personnel. Community Development <br /> Department staff time may include overhead costs and will be consistent with Department <br /> policy. <br /> 2. DEPARTMENT OF PUBLIC WORKS: <br /> a. Surveys shall be conducted to show that the 100-year flood will not affect the landfill <br /> operation, and the surveys shall be delineated on the Improvement Plan. (Development <br /> Title Section 9-1135.2) <br /> b. The Traffic Impact Mitigation Fee will be required for this development. The fee is due <br /> and payable prior to the time of expansion. Eighty percent of the fee may be deferred <br /> over a period not to exceed five years by entering into a Deferred Traffic Impact Mitigation <br /> Fee Payment Agreement with the County. If deferred, the initial payment is 20 percent <br /> of the total fee based on $359.00 per additional daily trip-end generated in the Manteca <br /> area. The fee shall be automatically adjusted annually by the Engineering Construction <br /> Cost Index as published by the Engineering News Record. (Resolutions R-90-304, R-91- <br /> 1025, & R-93-167) <br /> C. The driveway approaches shall be improved in accordance with the requirements of San <br /> Conditions of Approval - 2 - UP-91-12 <br />
