(2) For the purpose of this subdivision, "substantial change" means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507, change the operational knowledge of the facility, or impede implementation of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. Resolution The noted chemicals have been added and submitted through the CERS portal. 3 Jason Palarca 08/03/2024 12/12/2024 Recommendation #6 EP #00032 - San Joaquin County CUPA Inspection HMBP- OBSERVATION: Training records for the handling of hazardous materials/spill response were not available at the time of inspection. REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program agency. (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to persons, property, or the environment. (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be documented electronically or by hard copy and shall be made available for a minimum of three years. CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the training records to the EHD. Resolution Chemical Safety Training is provided annually by the contractor B&L Neeley who provides the chemicals. The records were not available on the day of the inspection, but have been obtained since then. These records will be requested from B&L Neeley. 3 Jason Palarca 08/03/2024 10/04/2024 Recommendation #7 EP #00032 - San Joaquin County CUPA Inspection Hazard Waste- OBSERVATION: This business does not have a hazardous waste ID number in the California Department of Toxic Substances Control (DTSC) database which is valid. The ID number being used is CAL000437485, which expired 6/30/2020. REGULATION GUIDANCE: A hazardous waste generator shall not treat, store, dispose of, transport or offer for transportation, hazardous waste without having received an Environmental Protection Agency (EPA) Identification (ID) Number. A State EPA ID number is required for generators of less than 100 kg RCRA hazardous waste per month, less than one kg of acutely hazardous waste per month or any amount of non- RCRA hazardous waste. ID numbers are unique to a business and site location. CORRECTIVE ACTION: Go to the DTSC web site at https://dtsc.ca.gov/apply-for-hazardous-waste-epa- id-number/ to obtain an ID number. Immediately apply for your ID number and submit evidence to the San Joaquin County Environmental Health Department within 30 days.
