R5-2010-0016 -22- <br />SAN JOAQUIN COUNTY DEPARTMENT OF PUBLIC WORKS <br />NORTH COUNTY LANDFILL <br />SAN JOAQUIN COUNTY <br /> <br /> <br />to occur, as indicated by the most appropriate statistical or nonstatistical data <br />analysis method and retest method listed in this Order. <br />8. The discharge shall not cause any increase in the concentration of waste <br />constituents in soil-pore gas, soil-pore liquid, soil, or other geologic materials <br />outside of the Unit if such waste constituents could migrate to waters of the <br />State in either the liquid or the gaseous phase, and cause a condition of <br />nuisance, degradation, contamination, or pollution. <br />9. TWW shall not be discharged to landfill modules that are leaking. Upon <br />confirmation of a leachate release (or of a LFG release containing one or more <br />TWW constituents) from the landfill to the unsaturated zone and/or <br />groundwater, all TWW discharges to that module shall be ceased until such <br />time as corrective action measures result in cessation of the leak/release. <br />Such cessation of waste discharge shall be noted in solid waste reporting <br />under MRP Reporting Requirement H.2.a.ii. (See also Discharge <br />Specifications B.8 and B.10.) <br />10. The waste discharge prohibitions herein shall supersede any conflicting or <br />contradictory provisions in the April 2000 Standard Provisions and Reporting <br />Requirements (SPRR) applicable to waste discharge to an active or closed <br />landfill. See also SPRR Section I.E. <br />B. DISCHARGE SPECIFICATIONS <br />1. The discharge of solid waste to the landfill shall be limited to the following: <br />a. The existing landfill footprint (i.e., Modules 1, 3, and/or 4); <br />b. Lateral expansions of the existing footprint within the unit area constructed <br />with a Subtitle D composite-liner and LCRS or approved EADs per under <br />Construction Specifications D.1 through D.3; and; <br />c. Vertical expansion over B.1.a and/or B.1.b up to the maximum fill <br />elevations listed in Finding 57 of this Order, including cover material, as <br />supported by geotechnical analysis (Findings 58 and 59) and approved by <br />the Local Enforcement Agency. <br />2. The discharge shall remain within the designated disposal area at all times. <br />3. The Discharger shall, in a timely manner, remove and relocate any wastes <br />discharged at this facility in violation of this Order. <br />4. Consistent with liquids restrictions in Title 27, Section 20340(g) and Subtitle D <br />(40 CFR 258.28), the return of landfill leachate and/or LFG condensate back to <br />the landfill shall be limited to those modules constructed with a Subtitle D <br />composite liner (or equivalent approved EAD) and LCRS (i.e., Modules 3, 4
